On January 14, 2009, the Division of Water Quality (DWQ) received your minor variance application dated
December 15, 2008, to fill or otherwise impact 11.68 square feet of Zone 2 Neuse River protected riparian
buffers to construct the proposed porch at the site. The DWQ has determined that your application remains
incomplete and/or provided inaccurate information as discussed below.
1. On January 22, 2009, the DWQ sent a "Request For More Information" correspondence to you.
On January 28, 2009, the DWQ received a response to our January 22, 2009, "Request For More
Information" correspondence to you, however, you did not address Parts 4, 5 and 9 (checklist) as
previously requested.
For these reasons your minor variance application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete application
package with the appropriate fee.
Please be aware that you have no authorization under the Neuse River Buffer Protection Rules (15A
NCAC 2B .0233) for this activity and any work done would be a violation of North Carolina General
Statutes and Administrative Code. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-1786 if
