• Goals of the study were to:
• Determine the volume of water needed to keep the
ponds full during dry periods (waterfront lots
apparently sold for %20 more)
• Identify a groundwater resource in the vicinity of
the ponds to keep the ponds full
• "Determine the impact of installing perforated
piping along the pond side of lots 177-183, the
wetlands side of lots 136-138, and the southwest
end of pond #2, adjacent to lots 31 and 32."'

Although tlx: monitoring well rcidings are not conclusive, it is possibic tlx: perfnraled cutlet pipe
al the cashxn end of the lowrar pond may intercept an inklerminata amount c gmundwater and
direct it away from the pond. Manse water naturally moves through the ground towards the
nearest outlet, the perforated outlet pipe may be affecting the maxirntun elevation ofthe water
level in the pond.
Seascape is willing, without admission of wrongdoing, to remove the perforated outlet pipe and
atone between the eastern outlet box aaci the road right-cf--way. A professional engineer will
determine if the western outlet box will adequately handle storm events, aril, if so, the eastern
outlet area will be filled in. Otherwise, a replacement solid pipe will ke instaliad. Please pato
that, due to recent extreme drought conditions, it may take multiply wet years before" water levels
in the ponds rise above the ground surface.
The US Army Corps of Engineers is sebedulod to determine if the lower pOxtida atC jurisdictional
wetlands, and it may be necessary for monitoring wells #1 and Kw cornain in plum through the
next growing season before such a determination can he made, If, following rooeipt of that
monitoring data after the next growing season, the Carps de rrminms lk arca is not jurisdictional,
SeaScape will move forward with removal of the pipe as dmribcd above within 120 dsys of tiro
determination with the understandings that this is the only feasible remedial action tha# Sea.�cape
can take and that DWQ will take no farther action against &xScape relative to the 1x)nds or the
assotsiatod stormwater system.
Even if the Corps determines the area is still jurisdictional but the water level in the lower pontis
does not rise under normal canditivas Ws winter, Wcaipe ►gill move forward with removal of
the pipe within 120 clays ref the determination with the understand inp that it will be a voluntary
tu'tian oat required by DWQ and that DWQ will take no further action against 5eaScape relative
to the ponds or the associated stormwater system.

Chronology
• 09/21/1999 - SW Permit Issued
• 10/22/1999 - USACE signs wetlands map for entire tract
• 09/06/2000 - 401 Issued 2000-1005 & 2000-1078 for upland marina basin and other infrastructure
• 03/08/2000 — SW Permit Mod Issued. Permit allows for minimum amount of piping shown on the approved plan that is
associated with the outlet structures of the wetland ponds for the purpose of flood control. However, the outfall
piping was not reviewed as part of the Permit Approval Process since it is not for storm water treatment.
• August -September 2000 - Water supply wells constructed to pump water into ponds
• 04/23/2001— SW Permit Mod Issued. Plans show approximately 300 linear feet of 48" RCP leaving the outlet structure
for Eastern Pond (2) and approximately 480 linear feet of 48" RCP leaving the outlet structure for Western Pond (1)
• 07/03/2003 - 401 app received (2000-1078ver2) proposal for additional boat ramp, retaining wall, four additional
docks & 404 wetland fill for 4 road crossings
• 08/06/2003 — SW Permit Revision — For the marina area layout changes only. The approved plans show the same
lengths and locations as on the 4/23/2001 approved plans
• Sometime in 2003 - Additional water supply wells constructed (12 total) to pump more water into Eastern Pond
• 11/05/2005 - Work finished on applying "clay -like" material in the "lower pond" (Eastern & Western) to prevent
seepage (POA Board meeting minutes)
• 02/16/2006 - Attempts to seal the ponds have failed (POA Board meeting minutes)
• 11/01/2007 — POA Board recognized that the ponds were under jurisdictional of the Clean Water Act as 404 and that
an engineer had been hired for the leakage problems (POA Board meeting minutes)
• 02/21/2008 - Engineer identified a problem of water loss into the ground and through the outfall pipe to the marina.
Installation of a pneumatic plug to the outfall pipe identified as a possible solution(POA Board meeting minutes)
• 04/02/2008 - SW Permit Mod Issued. Plans show East Pond, the first 100 feet of 48" RCP is now 48" HDPE and all of the
remaining 48" RCP is now perforated pipe. For the West Pond, the permitted 48" RCP remains unchanged.
• 04/17/2008 - Installation of the pneumatic plug is complete. More plans for sealant application are mentioned. (POA
Board meeting minutes)
• 06/19/2008 — Additional sealant has been applied to the ponds, engineer is monitoring the water levels in the ponds.
They are going to divert some of the water to the east pond section to stabilize the water levels. (A ditch and PVC
piping was installed between the two ponds) (POA Board meeting minutes)
• 10/16/2008 - Drawdown test scheduled by the engineer for the lower ponds. More sealant was added. (POA Board
meeting minutes)
• 03/06/2009 - 401 WQC issued 2000-1078ver3 for marina dredging
• 04/29/2009 - DWQ visits the site for the first time after homeowner complaints. Observes water in both lower &
upper ponds and that wells are pumping groundwater into both ponds.
• 03/19/2010 - NOV issued by WiRO for wetlands draining violations based upon information from Nat Wilson of the
DWR.
