This conveyance is made TOGETHER WITH and SUBJECT TO the reservation of a non-exclusive, perpetual right of way and easement over and across the existing access roads depicted on the herein above referenced plat of survey as a means of vehicular and utility ingress, egress and regress from the above described lot and the remaining appurtenant lands of Grantor to the public road. This conveyance is SUBJECT TO the reservation of a non-exclusive perpetual right of way and easement over and across the access roads in favor of appurtenant lands of James Land, LLC and lands after acquired by James Land, LLC as reserved in Deed Book CRP 1192 at Page 504 of the McDowell County Public Registry. Pathways located in the protective vegetation buffer governed by the Lake James protection ordinance will only contain natural base such as mulch or wood chips. In some cases steps will be required due to grade, but pathways will not contain impervious surfaces.
