Mr. David Fortuna Page Two 9. PROJECT DESCRIPTION: The project site is located at Lot 31, Barnes Bluff Drive, adjacent to the AIWW, located on the mainland side of Oak Island, Brunswick County. To find the project site travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC- 133.Tum onto Dosher Cutoff and then turn right at Southport-Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn left onto NC-133. Follow NC-133 approximately 1.3 miles to Fish Factory Road (SR 1101). Turn left on Fish Factory Road and travel approximately 0.9 miles to Barnes Bluff Drive. Turn left at the first cul-de-sac and the property will be located directly ahead. The property consists of a lot, approximately 1 acre in area, owned by Mr. Fortuna, with an approximate elevation of 5' above normal high water (NHW). Vegetation on the high ground portion of the lot consists of lawn grasses, pine (Pinus spp.), Oak (Quercus spp.) and Eastern Red Cedar (Juniperus virginiana). A slough runs along the western property boundary of the lot, separating it from the development's common area. The high ground on the property then transitions to high marsh species. A band of Sea Oxeye (Borrichia frutescens) and Salt Meadow Hay (Spartina patens) extends approximately 50' in width, which then transitions to approximately 35' of Spikegrass (Distichlis spicata), Glasswort (Salicornia spp.), with a small patch of Black Needlerush (Juncus roemerianus) and Salt Marsh Cordgrass (Spartina alterniflora) interspersed. The high marsh then transitions to low marsh, approximately 25' in width, vegetated primarily by S. alterniflora. Common Reed (Phragmites australis) borders the eastern property line. There are currently no man-made features on the site. State Permit 9161-97 was issued for Barnes Bluff subdivision and associated amenities on December 19, 1997. State Permit #66-04 was issued on May 3, 2004 for a community docking facility. A common area was to be created from the re-platting of Lots 29, 30 & 31, which was to be recorded with the Brunswick County Register of Deeds prior to the commencement of construction. As approved, Lot 31 was to be divided along the slough located on the property and the area west of the slough was to be deeded as common area. The shoreline from this area was utilized for the community dock. Permit condition #3 also states that no individual docks shall be built on Lots 21-30, however, Lot 31 does not appear to have any restrictions other than a reduced shoreline length. According to the Brunswick County GIS website, this re-platting of Lots 30 & 31 has not yet been recorded and the Lot 31 was sold in 2004 to the current owner and applicant, Mr. David Fortuna. The Oak Island Land Use Plan classifies the adjacent waters as Conservation. The waters of the AIWW are classified as SA by the Division of Water Quality. They ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant is requesting to construct a foi:.r. slip private docking facility. Plans reflect the property boundaries and shoreline for Lot 31, as they were required to be recorded as a condition of State Permit #66-04. The applicant is proposing a pier, measuring 155' in length and 6' in width, extending across the marsh towards the AIWW. A roofed gazebo is proposed at the outer edge of marsh, which would measure 20' in length by 20' in width. A ramp would then lead from the gazebo onto a 10' in length by 10' in width floating platform/ramp landing. An L-head is then proposed parallel to the AIWW, measuring 30' in length by 8' in width. Two finger piers, measuring 50' in length by 4.5' in width, are Mr. David Fortuna Page Three proposed on either end of the T-head, running perpendicular to the T-head and the AIWW. The water depth at the outer edge of the T-head is approximately --4.0' at Mean Low Water (MLW) and the depth at the outer edge of the finger piers is approximately -6' at MLW. The docking facility would accommodate four vessels, as proposed. 10. ANTICIPATED IMPACTS The docking facility would incorporate approximately 2,390 sq. ft. of Estuarine Waters and Pubic Trust Area. The pier would shade approximately 840 square feet of coastal wetlands and what appears to be §404 wetlands, approximately 150 sq. ft. of which is Salt Marsh Cordgrass (S. alterniflora). The dock would not encroach into the adjacent 15' Riparian Corridor Setbacks. The proposed docking facility would extend approximately 120' into the AIWW, which measures approximately 520' across, thus conforming to the'/4 width rule. It would not extend into the USACE 80' setback and does not exceed the established pier line. Minor increases in turbidity should be expected during construction. The applicant, David Fortuna, proposes to install a 6' x 155' walkway that will lead to a 20' x 20' covered deck area. An aluminum ramp will lead to a U-shaped floating dock that will consist of a 10'x 10' landing area, an 8' x 30' section with (2) 4'/z' x 50' finger piers. This property is adjacent to the Intracoastal Waterway and will provide safe access to the water body for the applicant. This area is fortunate to have deep water in the area around the proposed pier. The proposed construction will not be a hazard to navigation, will not encroach on the adjacent riparian corridors, and will not adversely affect Public Trust Waters. The "future lot line" is a condition that is currently being litigated. The original developers are working to have the lot re-recorded to show the new lot line.
