STORMWATER MANAGEMENT PLAN IMPLEMENTATION
Dear Mr. Hughes:
On November 30, 2005, the Union County Public Schools was issued a Water Quality Certification for
the purpose of constructing the subject property. Condition 1 of the Certification required a final written
stormwater management plan (SMP) approval prior to the construction of any permanent facilities. It
further required that before any building at the site is occupied, the facilities (as approved by this office),
shall be constructed and operational, and a stormwater management plan (as approved by this office) shall
be implemented. Due to noncompliance with this condition resulting from the construction and occupancy
of permanent structures on site with no approved SMP in place, a Notice of Violation (NOV) and Notice
of Recommendation for Enforcement (Incident #: 200703447, & NOV-2007-PC-0808) were issued to
you and Union County Public Schools.
On July 3, 2008, the Division of Water Quality (DWQ) approved the SMP dated June 12, 2008 and June
27, 2008, and a modification dated September 10, 2008, submitted by your Engineer Mr, Frank Henry,
RE of Estes Design. A condition in these approvals requires you to submit a Notice of Construction
within ten (10) days of commencement of construction. While a deadline was not specified in the
approvals, since this was an after-the-fact approval, this office is requiring you to implement the approved
SMP within 60 days from receipt of this letter. If this office does not receive your Notice of Construction
within 60 days, a second NOV shall be issued to you, and recommendations for enforcement shall be sent
to the Director of the DWQ for appropriate action. Please be advised that these violations are subject to
civil penalty assessments of up to $25,000.00 per day per violation.
