We received your email dated January 8, 2009 requesting further information be submitted to the
USACE in order to issue the permit for the above mentioned project. Below, the concerns from that
email are addressed along with other requirements described during numerous telephone
conversations.
1. Please provide a statement amending the Nationwide 14 PCN application, addressing the
type of mitigation you are proposing. As agreed, the statement will reflect your clients
intention to set up a conservation easement (CE) or deed restriction (DR) to offset the
proposed impacts at a ratio of 10:1 of Section 404 fi°eshwater wetlands; onsite and in kind.
The Corps will provide a Special Condition in the NW14 Permit indicating the timelines for
the recorded CE or DR to be submitted to the Corps.
As an amendment to Section VIII, Parts 1 and 2 of the NWP application form the applicant
proposes to preserve at a 10:1 ratio a total of 1.56 acres of 404 wetlands on the tract adjacent
to the 10 acre tract mentioned above. The adjacent tract is owned by Phillip K. Flowers, the
father of the applicant, Jordan B. Flowers. A signed slip from Phillip Flowers allowing
preservation of 1.56 acres of his property is enclosed.
The preservation map and language are currently being drafted. The applicant will use the
standard deed restriction language in order to put the required acreage into preservation.
2. Also, as discussed, the Corps would like to receive an enumeration of all the wetlands and
upland polygons on the site, individually calculated, then cumulatively, on a set of plats.
The wetland survey plats were originally submitted to you for signature January 30, 2008.
These plats did not include enumerated wetland and upland boundaries so the survey is
preparing plats that will include this information. These surveys will be submitted to you as
soon as they are received from the surveyor.

As discussed the NC DWQ has required buffer mitigation for the 2,048ft2 of Zone 2 impacts. An
In-Lieu Request Fee Form has been submitted to the NCEEP to provide the NC DWQ required
3,072 ft'` of mitigation credits. A copy of this application form has also been enclosed for your
inforrnation.
