Subject: Proposed improvements to Stouts Railway in Union County, TIP P-9704. DWR #20171250
Dear Mr. Bridges:
The Division of Water Resources has reviewed your submittal for a 401 Water Qualiry for the aforementioned
project. Review of your application revealed it Iacking necessary information required for making an informed
permit decision. The permi[ application was deficient in [he following areas:
• Provide reasoning for use of pump around instead of diversion ditch for working in the dry because
diversion ditches are the pmferred work in the dry BMP.
• No mitigation is proposed for stream impacts; please provide documentation of USACE decision [o waive
stream mitiga[ion
Therefore, pursuant [o ISA NCAC 2H .0507(a)(5), we will have to place ihe permi[ application on hold until we are
supplied the necessary information. You have 21 days to respond in writing with the requested information or
notificanon ro this office that the information is fonhcoming. It, at the end of the 21 days, this oftice has not
received this information in writing, we will assume you are withdrawing your application and it will be returned.
Furthermore, until the information is received by the NC Division of Water Resources, we reques[ (by copy of [his
letter) [hat the US Army Corps of Enoineers place the permit application on hold.
