PROJECT DESCRIPTION Bald Head Island is part of an island group known as Smith Island, located at the confluence of the Cape Fear River and Atlantic Ocean between Fort Fisher and Oak Island/Caswell Beach in Brunswick County. The island is accessed by private boat or a private ferry service from Southport. The proposed borrow area site is located at Jay Bird Shoals. Jay Bird Shoals is located west of Bald Head Island and the federal navigation channel for the Cape Fear River. The project borrow site and disposal area is bordered by the Atlantic Ocean to the south and east, the Cape Fear River to the west and residential properties to the north. The project area on South Beach is located within the Ocean Erodible Area of Environmental Concern (AEC) and high ground portion is vegetated primarily American Beach Grass (Ammophila breviligulata) and Sea Oats (Uniola paniculata). The annual erosion rate for the project area is 8'/year per the Division of Coastal Management's 2011 Annual Erosion Rate maps. The South Beach portion of the project falls within the USACE Wilmington Harbor Sand Management Plan (WHSMP) project, which authorizes the placement of material excavated from the federal navigation channel on South Beach at Years 2 and 4 of a 6 -year cycle. South Beach last received sand under the federal project in the winter of 2014/2015. State Permit #139-10 authorized the dredging of approximately 140,000 cubic yards of additional material from the mouth of Bald Head Creek, which was placed on both West & South Beaches in 2012. State Permit #9-95, issued to the Village of Bald Head Island, authorized nourishment of a portion of South Beach. A minor modification of the permit was granted on July 7, 1995 by means of a CRC variance, for installation of the sand groin field on South Beach (Federal Permit #199404687). A minor modification of State Permit #9-95 was also issued by CRC variance for the construction of a 300 -linear foot sandbag revetment west of Groin #16 and extending towards "The Point" on August 8, 2011. State Permit #67-09 was issued to the Village of Bald Head Island for the dredging of approximately 1.86 million cubic yards of sand from Jay Bird Shoals for the renourishment of South and West Beaches. This permit was modified on September 2, 2009 to increase the depth of excavation within the bounds of the approved borrow area to -24' NGVD29 (22' design depth plus 2' overdredge allowance). Work under this permit was performed in 2010 (see Sheet 1 of 7 for limits of work). On March 27, 2011 State Permit No. 67-09 was modified again to increase the line spacing and decrease the survey buffer for post -construction survey requirements. The current proposal has been submitted as a major modification to State Permit No. 91-14, which was issued to the Village of Bald Head Island on October 21, 2014 for construction of a terminal groin structure and associated sand fillet. This permit is due to expire on December 31, 2017. Phase I of the terminal groin (I 100 ft. long section) was constructed at "The Point" in 2015. A previous major modification request submitted earlier this year to use Frying Pan Shoals as a long term borrow site has been rescinded. The applicant is now formally requesting processing of a revised major modification request to use Jay Bird Shoals as a one-time borrow source. In concurrence with Condition No. 22 of State Permit No. 91-14 the applicant has indicated that they have initiated formation of the Technical Advisory Committee (TAC) for this modification request. Village of Bald Head Island Major Modification to State Permit No. 91-14 Terminal Groin Fillet and Beach Fill Page Three The waters of the Atlantic Ocean contiguous with this portion of the Cape Fear River are classified as SB by the North Carolina Division of Water Resources. The waters are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing a Major Modification of State Permit No. 91-14 for the one-time use of Jay Bird Shoals as a maintenance borrow site for sand placement on South beach, and the terminal groin fillet, on Bald Head Island. According to the applicant, Jay Bird Shoals contains an approximately 127 acre sand source, which includes a 12.5 acre cultural resource exclusion area in northeast corner of the proposed borrow site. The application states that the use of the previously permitted JBS borrow site, including portions of previously dredged borrow Area 2, and the remaining undredged borrow Area 3 (see Narrative and Sheet 6 of 7) would address the immediate nourishment needs of both South Beach and the terminal groin fillet. The application states that the 2017 monitoring surveys project an estimated 963,000 cubic yards of sand is available in the undredged portion of the site and a similar volume remaining in the previously excavated areas. In the original application for the terminal groin project the applicant had stated that the preferred sand source for fillet creation was the remaining portion of the Jay Bird Shoals borrow site authorized by State Permit 67-09. A discussion on "Borrow Site Formulation" for Jay Bird Shoals is included. (see Narrative and "Jay Bird Shoals Borrow Site Re-evaluation" CD). The re-evaluation report states that the "Village will be the recipient of the next two (2) federal channel maintenance/beach disposal projects pursuant to the WHSMP. This would theoretically allow the use of the Frying Pan Shoals borrow area to be deferred nearly 10 years into the future. It does not, however, obviate the need to complete the permitting of the Frying Pan Shoals borrow site since it may likely be required as a sand source after a hurricane or severe storm event". The current application states that the Village of Bald Head Island does intend to re-initiate permits for the future use of the Frying Pan Shoals borrow site. An estimated 1 million cubic yards of material is proposed to be excavated to a depth of -24' NGVD29 (22' design depth plus 2' overdredge allowance) from borrow Area 3 (outside of the cultural exclusion zone) and within portions of previously dredged borrow Area 2 for placement on South Beach (see Sheets 6 and 7 of 7). Within the proposed borrow areas, two areas of magnetic anomalies were previously found, the cultural exclusion zone to the north and a federal tide gauge to the southeast. The narrative states that an evaluation is being conducted to determine if the spatial limits of the exclusion zone may be reduced. Approximately 62 acres of area labelled as borrow Area 2, which was previously dredged during the 2010 project, will be re -excavated and approximately 64 acres would be excavated from borrow Area 3 (see Attachment A). Please note that the "Jay Bird Shoals Borrow Site Re-evaluation" reflects limited excavation volumes from Village of Bald Head Island Major Modification to State Permit No. 91-14 Terminal Groin Fillet and Beach Fill Page Four borrow area 3, this has been revised in the permit application to reflect the dredge limits discussed herein. The application states that 8 Vibracores were analyzed for sand quality within the infill areas of the previously dredged borrow Area 2 in order to verify sediment quality or acceptability as beach fill on South Beach. (see Narrative, Sheet 5 of 7 and the "Bald Head Island, N.C. Jay Bird Shoals Borrow Site Re-evaluation" report). According to the report all JBS depositional material above elevation -24 ft. NGVD29 is fine sand classified as being predominately SP and all composite sample sediments over depth meet State Standards for placement as beach fill on South Beach. The report further states that for the eight (8) cores acquired, the average mean grain size for all composite samples was 0.21 millimeters (mm), Carbonate percentages from all composite samples ranged from 4.1 percent to 8.2 percent, with an average of 5.8 percent, and the fine-grained content (i.e., silt and clay -sized sediment) was less than 3.1 percent in each of the composite samples collected from site wide cores. Work would be conducted utilizing an ocean certified cutter suction dredge and material would be deposited on South Beach via a submerged pipeline. The application states that the submerged pipeline for the current project may require burial under the federal navigation channel. On March 29, 2010, the Village of Bald Head Island and Norfolk Dredging received Notices of Violation for unauthorized pipeline trenching across the BHI Shoal Channel. Restoration was not required as the material was determined to be beach compatible at that time. The current project may require impacting the same location in an area measuring approximately 1500 ft. long by 250 ft. wide area (300,000 sq. ft.) (see Sheet 6 of 7). If deemed necessary, the pipeline would be placed below the authorized channel depth of -44 and the resulting "disposal "material would be deposited on south beach. No current sand criteria has been submitted for this crossing, the applicant states that the material consists of previously documented beach compatible sediment. The proposed beach fill project would have an excavated volume of up to lmillion cubic yards of material placed for the current event. According to the applicant, the proposed limits of the beach fill template on South Beach extends approximately 9,100 linear ft. beginning east of the terminal groin at Station 45+07 and terminating at Station 134+00 with a 200 ft. taper to existing grade (see Sheet 2 of 7). The application states that the maximum width of the fill template is 400 ft. with a 200 ft. maximum distance waterward of Normal High Water (NHW). The fill template is within the federal template on South Beach, which has been the recipient of multiple projects associated with the Wilmington Harbor navigation project (beginning in 2000). The applicant states that the beach construction berm will maintain an 8ft. elevation in order to be consistent with prior USACE disposal events. The beach profile would have an average beach fill density of 100 cubic yards per linear ft. over the length of the entire 9,100 disposal template area (see Sheet 3 of 7). According to the applicant, the proposed fill area will be continually utilized for future navigation maintenance events by the USACE and for terminal groin updrift fillet maintenance events by the Village of Bald Head Island. Please note that Adjacent Property owner notification receipts have not been received by this office at the time of processing. ANTICIPATED IMPACTS: The proposed excavation of the Jay Bird Shoals Borrow site could result in the excavation of approximately 5,532,000 sq. ft. of Public Trust Area and Estuarine Waters with a possible additional 300,000 sq. ft. from the potential channel crossing. The subsequent beach disposal would result in the filling of approximately 1,820,000 sq. ft. of unvegetated beach above MHW and approximately 1,820,000 sq. ft. of area below MEW. The proposed borrow area and associated "crossing" contains the potential for excavation of up to 134 acres of Public Trust Area and Estuarine Waters. Minor increases in turbidity should be expected during construction. Submitted by: Tara MacPherson Date: November 14, 2017 Office: Wilmington ATTACHMENT B PROJECT NARRATIVE (CAMA 91-14) BACKGROUND FOR THE REQUEST FOR PERMIT MODIFICATION VBHI annual Monitoring Report No. 15 (Olsen 2017) documented that between April 2016 and May 2017, South Beach at Bald Head Island lost a total of 619,000 cy (above elevation -16 ft NGVD). This amount well exceeded average annual losses measured over the last 17 years and was principally due to the effects of Hurricanes Hermine and Matthew in 2016. As a result, the Village Council has authorized the design and permitting of the 1 Mcy interim beach fill discussed above to be constructed in the fall/winter of 2018/19 — at the latest. Recently, formal permit applications for the development of a long-term borrow site within Frying Pan Shoals were being processed. Those applications requested a major modification of State Permit No. 91-4 and federal permit SAW -2012-00040 — which were issued for both the terminal groin constructed in 2015 and subsequent fill activities required to keep the structure updrift fillet full pursuant to N.C. Statutory requirements. On both 27 July 2017 and 2 October 2017 that Application was formally withdrawn by LMG — as Permit Agent. In June 2017, the National Marine Fisheries Service (NMFS) issued concerns related to the near term use of the Frying Pan Shoals (FPS) borrow site without first exploring and exhausting other viable sand -source alternatives. Realistically, the only alternate borrow area available for near term sand placement at Bald Head Island (BHI) is sand remaining in the previously permitted JBS borrow site. Accordingly, in consideration of the NMFS request, the Village has agreed to prioritize the use of the previously authorized borrow site permitted at Jay Bird Shoals (JBS) (including both the partially recovered area dredged in 2009/10 and the remaining undredged portion of the borrow site). Options other than JBS and FPS are not feasible at this time. For instance, there is not sufficient sand volume within the two Bald Head Creek borrow area(s). Moreover, only a very small dredge can be utilized at that location. Therefore, the Bald Head Creek site is not suitable for any large-scale nourishment event at S. Beach. With respect to the Wilmington Harbor Channel as a potential sand source, all sand to be -1- 30 OctoberARIVED DCM WILMINGTON, NC excavated by the Corps of Engineers (COE) in 2017/18 as part of their regularly occurring channel maintenance program will be placed on Oak Island pursuant to the terms of the Wilmington Harbor Sand Management Plan (WHSMP). Hence, there will not be sufficient sand quantities from that source available to the Village in the near future for placement at South Beach. It is estimated that the next federal beach disposal operation at BHI will not be until 2020/21. Within the originally developed JBS borrow site, the most recent monitoring surveys (Olsen 2017) document that there is an estimated 963,000 of sand remaining in the undredged portion of the site — lying outside a Cultural Resource Exclusion area. Additionally, there is almost a similar volume of depositional material which lies within the area previously excavated in 2009 — although not all of it is operationally accessible by a dredge. The predicted volume required to be placed within a design template on South Beach in 2018/19 is approximately 1 Mcy. The one time use of the previously permitted JBS borrow site (if viable in terms of both sand quality and quantity) would address the more immediate nourishment needs for South Beach and the terminal groin fillet. It should be noted that a long-term borrow site consisting of large volumes of beach -compatible sand (from a borrow site exhibiting physical conditions conducive for relatively rapid recovery) will ultimately be needed to offset long-term sand deficits along South Beach and West Beach. To that end, the Village intends to reinitiate permits needed for the future use of the proposed FPS borrow site. In the interim, use of the JBS site will likely be able to address the more immediate nourishment needs while deferring and ultimately reducing the near-term physical disturbance to the FPS site — pursuant to the request of the NMFS. BORROW SITE FORMULATION The original 226 Acre JPS borrow area as developed for the locally constructed 2009/10 beach fill was defined by approximately 31 VIBRACORES (see Figure 1). Over the course of the 2009 project, approximately 158 A of seabed within the permitted borrow site were dredged (see Figure 2) yielding a gross fill volume of about 1.85 Mcy. As shown in Figure 3, the dredge contractor was strategically limited to working only within Borrow Site Sub -Areas 1 and 2, thereby intentionally leaving Area 3 for future use. The residual volume of available sand within Area 3 after construction exceeded 1 Mcy. The 2009/10 project was constructed by Norfolk Dredging Company using an Ocean Certified 27" cutter suction dredge. During the permitting of the JBS borrow area, Olsen Associates, Inc. performed numerical modeling of a theoretically excavated borrow site for purposes of evaluating any potential impacts to the shores of Oak Island (Olsen 2007b). In addition, during the permitting of the 2015 terminal groin project, a separate and distinct borrow site impact analysis was performed using the more robust DELFT 3D numerical model (Olsen 2013). Both modeling investigations conservatively assumed the JBS borrow site was theoretically excavated in its entirety (as well as the Cultural Resource Exclusion Area) — when in reality the site was only 2/3`ds excavated. Neither in-depth numerical modeling study predicted quantifiable impacts to Oak Island. None -the -less, when Permits for the terminal groin were issued by State and Federal agencies in 2014, a Condition was added at the request of certain interests on Oak Island that should the permittee receive a future permit modification to dredge more than 250,000 cy of material from the JBS borrow site (presumably from the remaining unexcavated Area 3), the Village would be required to monitor and analyze a large segment of eastern Oak Island for potential project impacts. At the time of permit issuance, severe time constraints associated with the bid and construction schedule for the terminal groin necessitated that the Village not seek to challenge such a Condition. The Village is now requesting a permit modification authorizing the one time dredging of approximately 1 Mcy of sand from the JBS borrow site originally permitted based upon the following considerations: 1. It potentially defers the use of the FPS borrow site over the next several years (possibly up to a decade into the future) pursuant to the recommendations of the NMFS. r:ECEjVED OCM WILMI14GTON, NC 2. It meets the intent of the original terminal groin Permit Condition which identified Jay Bird Shoals as a potential alternate borrow area suitable for future use, and 3. It addresses the requirement stipulated by both Permit Condition and State Statute for the Village as Sponsor of the 2015 terminal groin project to keep the updrift fillet of the structure full. JBS BORROW AREA RE-EVALUATION The developed JBS borrow site in its entirety has been surveyed by the Village every 1 to 2 years subsequent to its use in 2009/10. The April 2017 monitoring survey shows areas of gross deposition amounting to 891,000 cy. It is therefore possible to dredge borrow site Area 3 to construct a 1M cy beach fill if supplemented by depositional material from within borrow site Areas 1 and 2. That is to say, the configuration of the Cultural Resource Exclusion Area may preclude the dredging of 1 Mcy of material from Area 3 alone. As a result, the Contractor would be allowed to redredge portions of Area 1 and 2 which have shoaled. For purposes of this permit modification, the Village recently authorized for the rapid acquisition of 8 VIBRACORES within the largest candidate depositional area in order to verify sediment quality or acceptability as beach fill at South Beach (see Figure 4). All depositional material encountered was classified as SP and found to be beach compatible pursuant to criteria established by the State of N.C. A "dredge plan" defining the area of work is included as Figure 5. It should be noted that not all material in Areas 3 may be physically accessible by a large ocean certified dredge. Hence, the request to have access to a portion of the depositional material within Area 2, as necessary. All sand would be placed on S. Beach from the terminal groin eastward approximately 9,000 ft. The proposed timing of the work would be between 1 November 2018 and 1 April 2019, unless storm impacts and emergency conditions dictate otherwise. Work would be performed by an ocean certified cutter suction dredge with direct deposit on S. Beach by pipeline. Where the submerged pipeline crosses the federal navigation project, it would need to be placed below the authorized channel depth of -44ft. MLW. Any such material excavated to trench the pipeline below the channel would be placed on S. Beach — as was done for the 2009 project. The sediments within the original Jay Bird Shoal borrow site limits (Areas 1, 2 and 3) were originally determined to be beach compatible by way of a comprehensive Sand Search (Olsen, 2007a) performed prior to the 2009 locally constructed beach restoration project. A Cultural Resource Exclusion Zone totaling 12.5 A was required at the time. With further field investigations, the spatial limits of that Zone may be subject to reduction prior to the initiation of construction. Such an evaluation by Tidewater Atlantic Research, Inc. (TAR) has been authorized by the Village. Depositional sediments in Area 2 which will be subject to re -excavation during a beach fill project in the winter of 2018-2019 were evaluated through the acquisition of eight (8) additional VIBRACORES in July of 2017 by the firm of Athena Technologies, Inc. Subsequent laboratory analyses of composite samples over the assumed depth of excavation — were performed and reported. The proposed fill area will be continually utilized for the future placement of navigation channel maintenance material by the Wilmington District, USACOE as provided for in the Wilmington Harbor Sand Management Plan. An informal discussion with Doug Huggett in this regard indicated that the State would at this time opine otherwise. As a result, the Dredge Plan reflected by the current permit application seeks to dredge all (or most of Area 3) and supplement that volume with the excavation of depositional material within a portion of Area 2 (see Permit Sheets 6 of 7 and 7 of 7 dated 10/23/17). 12.
