I like the matting idea, great way to work in wetlands and Waters with little if any permanent impacts. Reading through your narratives, several areas caught my eye: Page 1 (Project Description): #2. The second step will be to install the creek crossings which are a combination of two rock check dams with a rock lined bottom across the creek. -This is a little more of an impact than "matting", the "rock lined bottom" could be considered as fill or a discharge into waters. Stream Crossing Narrative (pg. 1) Crossing number 2 -The northern bank will have to be graded so that construction equipment can cross the stream at this point- The NWP 12 states on page 1 (Utility Lines) "There must be no change in pre -construction contours of waters of the US" I'm not sure if this would change the contours of the stream, but it changes the original bank of the stream. To do this you would be doing "mechanized grading and digging" on the stream bank and possible in wetlands. Also are the sizes and locations of the 7 crossings accurate? They might change depending on seasons, how did you determine where they are located? GPS, etc.? Unfortunately this project is going to be more difficult than originally thought. I think we can still use the NWP 12, we just have to figure out the items listed above. Respectfully, Gary 1
