Hey Raymond,
I have finalized my review of the Benton Branch Final BPDP submitted to DWR on 11/2/17. Everything looks great and
well organized, which made the review much easier! Thank you for addressing all of my previous comments and
concerns. I have provided just a couple of remaining edits that need to be made.
1) Into: correct rule reference 15A NCAC 0213. 0295 & there is a reference to Figure G1. Should that reference be
to Figure 8 instead?
2) Section 6.0— Clarify this paragraph as follows...
The Sponsor will maintain four credit ledgers, if applicable, for the Parcel under the UMBL- one for Buffer Restoration
mitigation credits and one for Buffer Preservation and Enhancement mitigation credits, both in square feet and acres... "
in pounds and acres.
3) Section 4.1— change submittal of 1St monitoring data from "Fall 2017" to another date (2018?)
4) Section —There must be some form of monitoring (even if just documentation of "visual" monitoring/inspecting)
in the cattle exclusion areas and Preservation areas to comply with the rule. Here is what we have approved
before...
A visual assessment of the cattle exclusion and preservation areas within the conservation easement will also be
performed each year to confirm:
Fencing is in good condition throughout the site;
no cattle access within the conservation easement area;
no encroachment has occurred;
diffuse flow is being maintained in the conservations easement area; and
there has not been any cutting, clearing, filling, grading, or similar activities that would negatively affect
the functioning of the buffer.
5) Introduction & Section 6.0— both sections state that the maximum acreage that can be transferred from buffer
credits to nutrient offsets is 10.89 acres. How did this number get calculated? Did you mean 10.91 acres,
considering it would apply to all of the Restoration acreages from TOB -100' as listed in Table 4? Is this correct?
