PROJECT SUMMARY: The applicant is proposing to permanently establish an existing temporary concrete pier within the Cape Fear River. PROJECT DESCRIPTION The project site is located at 1500 Point Harbor Road, adjacent to the Cape Fear River, in Wilmington, New Hanover County. To locate the property from the Wilmington DCM Office, travel north on Cardinal Dr. Ext. and turn left on to Market St. Drive 0.4 miles and turn right on to Martin Luther King Jr. Parkway (US -74W). Travel 5.3 miles and then merge right, Isabel Holmes Bridge. Continue over the bridge and take a left at the stoplight on to US -17 South toward the Battleship. Proceed on US -17 South for 0.17 miles and take a left on to Point Harbor Road. Atlantic Coast Industrial will be on the left-hand side. The project is located on the west bank of the Cape Fear River, just south of the Isabel Holmes Bridge adjacent to the US Army Corps turning basin right-of-way. The property is approximately 3.46 acres, averaging approximately 2.6' above normal high water (NHW). The site is currently utilized for commercial berthing operations to load and unload industrial materials. Existing structures include: office buildings, timber dolphins, floating platforms, and a fixed concrete pier. The application states the material comes in on various barges and boats to facilitate local and state marine construction and demolition projects. The material is stored on site or transported off-site by truck or boat. The existing temporary authorized concrete pier measures approximately 35' in length by 17' in width, which terminates onto a "T -head" platform measuring approximately 5' in length by 20' in width. The existing facility is located 73' from the US Army Corps of Engineers (USACE) Wilmington Harbor Line. State General Permit No. 63951 D was originally issued to ACI Holdings, LLC on June 19, 2014 for a temporary fixed concrete pier along the Cape Fear River. The pier served to assist in loading vessels for the Division of Marine Fisheries artificial reef program for 180 days. State General Permit No. 63951 D was reissued on December 19, 2014, July 21, 2015, January 25, 2016, September 7, 2016, and March 23, 2017, and expired September 23, 2017. ACI Holdings, LLC currently has two outstanding Notice of Violation (NOV); NOV 17-17D to remove debris below Normal High Water (NHW), and NOV 17-26D for an unauthorized fixed concrete pier. ACI Holdings, LLC has nearly completed the restoration requirements for NOV 17-17D, and resolution of NOV 17-26D is pending the submission of a major permit application for the existing concrete pier. Upland vegetation is sparse and consists mostly of wild grasses and few hardwood species located on the northeastern portion of the site. The shoreline of the property consists mainly of concrete and brick rubble from historic and current operations. Existing coastal wetlands are located on the northeast and southeast corners of the site includes Smooth Cordgrass (Spartina alterniflora), Phragmites, Salthmarsh bulrush (Scirpus robustus), and Big Cordgrass (Spartina cynosuroides), that is approximately 1 ft. to 85 ft. in width and 200 ft. in length. The waters of the Cape Fear River (in the vicinity of the project) are classified SC;Sw, by the N.C. Division of Water Resources. The area is designated as a Primary Nursery Area (PNA), by the N.C. Division of Marine Fisheries and these waters are CLOSED to the harvesting of shellfish. The New Hanover County Land Use Plan classifies the area as Conservation. PROPOSED PROJECT The applicant is proposing to incorporate the existing temporary concrete pier in to a major permit for permanent use. The existing temporary authorized concrete pier measures approximately 35' in length by 17' in width, which terminates onto a "T -head" platform measuring approximately 5' in length by 20' in width. and is located 32 foot US Army Corps of Engineers Harbor Line within the Cape Fear River. The applicant states that the pier would continue to function to aid in loading and unloading materials and equipment onto and off various barges and boats to facilitate marine construction and demolition projects, including transporting and emplacing materials to create artificial reefs. The pier would be accessible to crane mounted vessels 20-40ft in length, and supports a water depth of approximately 4ft at Mean Low Water (MLW) at the end of the pier. The applicant states that vessels will typically be secured to the existing offshore dolphins and use the pier to facilitate the loading and offloading of materials, therefore the applicant is proposing 0 slips at this pier structure. ANTICIPATED IMPACTS This proposal does not differ in concept from the temporary concrete pier authorized under State Permit No. 63951 D. Based on information presented by the agent and information on the pier in use, it is anticipated that there would not be adverse impacts associated with the operation of this pier. The pier does not encroach in to the riparian corridor of the adjacent riparian property owners and is located 32 feet from the US Army Corps of Engineers Harbor Line. The pier does not pose a risk to current vessel navigation within the Cape Fear River and could be conditioned for removal based on future water dependent needs in that area. The pier would have no additional adverse biological impact to the existing river habitat because no new construction will be needed. Potential impacts may include inadvertent filling within the vicinity of the pier from loading and offloading of material, however, best management practices .will be in place to reduce this risk. Inc. (ACI) operates a marine construction business at the site. Daily business operations include marine construction, commercial diving, pile driving, steel fabrication, marine salvage, concrete and steel structure demolition and construction. In addition to working for privately -owned entities, ACI regularly conducts business with various local and state government agencies to facilitate implementation of projects that are beneficial to public interest. Daily business operations consist of loading and unloading materials and equipment onto and off of various barges and boats to facilitate marine construction and demolition projects, including transporting and emplacing materials to create artificial reefs, as part of the Artificial Reef Program (ARP). The site is comprised of approximately 3.5 acres and is located on the western bank of the Northeast Cape Fear River, approximately 0.45 miles north of the confluence of the Cape Fear River and Northeast Cape Fear River. The site exists at the western extent of the 32 -foot turning basin in the Northeast Cape Fear River that was historically utilized and maintained. The shoreline along the normal high tide line currently exists primarily as broken concrete that was recycled and likely emplaced for shoreline stabilization. A series of dolphins also exist just off shore to secure vessels while loading and unloading materials and equipment. A temporary concrete pier (permitted under General Permit Nos. 67180 and 69013) was constructed to facilitate loading and unloading vessels associated with fulfilling a contract with the North Carolina Division of Marine Fisheries (NCDMF) to construct artificial reefs pursuant to the ARP. Vessels will typically be secured to the offshore dolphins, and the pier utilized, along with cranes and other equipment, to load materials onto the vessels. The permit for the temporary structure is set to expire September 23, 2017. The purpose of this permit application is to request permanent usage. All plans and specifications, as well as supporting documentation for this request are attached as exhibits, which are referenced within the application forms.
