Ross Jr., Secretary MEMORANDUM: December 11, 2008 TO: Doug Huggett b? t 3 /CI( THRU: Tere Barrett4 FROM: Heather Styron - RE: Modification of State Permit #161-07, Howland Rock Property Owners Day Dock Area Marina Improvement Project Please find enclosed a request from Mr. Judson Kenworthy representing the Howland Rock Property Owners Association to modify the CAMA Permit issued to Howland Rock POA. This permit, #161-07, was issued on 10/23/07, and is set to expire on 12/31/10. The permit authorized the addition of two soldier pilings to the existing docking facility, the placement of riprap and maintenance excavation. The applicants are requesting to remove what is currently known as the day dock area, which is 430' northwest from the mouth of the canal and located on the south side of the existing canal. It is also located west of the existing 9-slip main marina area, which is on the north side of the canal, and located a distance of 235' from the west side of the existing marina basin. The day dock area contains two existing slips, bulkhead and 4' x 30' dock. They are proposing the removal of this area in order to construct an upland basin. The basin would have a footprint of 27' x 42' at this location. The existing two slips would be relocated within the proposed upland basin with a new third slip added. This would be a total of 12 slips for the Howland Rock Property Owners Inc. There would be two 3' x 20' fingers located within the basin area to separate the three slips. Each slip would have an area of 10' x 20'. A total of 336 cubic yards would be removed for the basin construction to a depth of -3' nlw with 47 cubic yards removed at the canal area to a depth of -3' nlw. All spoils would be trucked offsite by the contractor to an approved site. The proposed basin sides would be located a distance of 10' from the existing property lines with 95' of bulkhead surrounding the basin and 10' along the west side and 10' along the east side of the basin area along the canal for a total of 115'. There is existing drainage swales located on the property, which would need maintenance as work is completed. If any work on the existing drainage swales and pipes are outside what is considered maintenance then this would be inconsistent with 7h .0209 (d)(10) and should be kept as such. The applicants have contacted Shellfish Sanitation and per an email dated October 14, 2008 they do not have any objections to this submittal. The proposal is consistent with the specific guidelines found in 15A NCAC 07H .0208. A check in the amount of $100.00 will be included with the request.
