The Town of Apex has decided against moving forward with the Lufkin Road Realignment project. On their
behalf, I have drafted a letter requesting that you rescind the permits previously issued for this project so that
The Town may request a re-imbursement of their mitigation payment made to NCEEP.
Hard copies of this request are in the mail, but in an effort to speed up this process, I have also attached the
request (as well as 404/401 approvals) to this email.

Permit Nullification
Dear Mr. Shern and Ms. Karoly:
On behalf of The 'town of Apex, Kimley-l-lorn and Associates, Inc. (KHA)
submitted a Preconstruction Notification Application for authorization to
construct the realignment of Lufkin Road at its intersection with Ten Ten Road in
Apex, NC under Nationwide Permit Number 14 on December 3, 2007.
A 401 Certification Approval was issued by NCDWQ on December 20, 2007 and
a General Permit Verification was issued by USACE on February 20, 2008. At
that time, The Town planned to move forward with this project and made the
required mitigation payment to NCEEP.
The Town has decided to forego this project and on their behalf, KHA is
requesting that you respond to this letter (letterhead or email will suffice)
rescinding the associated permits in order for The 'T'own to move forward with
their request of a re-imbursement for mitigation payments from NCEEP.
If there is any additional information you need, please do not hesitate to contact

a limited window of time in which to request re-imbursement of this payment.
