This permit, issued on January 22, 2009 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ka crnhiart to finPC imnricnnment or civil action: or may cause the permit to be null and void. 1) Unless specifically altered herein, all development shall be carried out in compliance with the attached list of workplan drawings: 2 dated 4/18/06, sheets 1 through 6 of 6 dated 9/4/07, and the attached letter from the permittee's authorized agent dated 7/1/08. Archaeological Assessment 2) Prior to initiation of any ground disturbing activities within the project area, the permittee shall arrange for an archaeological survey and assessment of site 31BR44** in terms of the NRHP. If the site is determined to be eligible for the NRHP, the permittee shall determine whether site 31BR44** will be adversely affected by the project activities; and if so, to develop and implement an appropriate mitigation plan. Two copies of all resulting archaeological reports, as well as one copy of the updated site form, shall be forwarded to the Office of State Archaeology (OSA) for review and comment as soon as they are available and in advance of any construction or ground disturbance activities authorized by this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Alf-Fc Bal Gra Harbor, LLC Permit # 12-09 t Page 2 of } f, ADDITIONAL CONDITIONS f Bulkhead and Riprap 3) The alignment of the authorized bulkhead and riprap shall be staked by the permittee and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse t weather conditions shall require the alignment to be restaked by the permittee and re-approved by DCM within a maximum of 30 days prior to the new expected start of construction. 4) The bulkhead alignment shall be located landward of the normal water level. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be solid and constructed of or treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. NOTE: The "redi rock" material proposed for the bulkhead are considered to be a suitable material for the purpose of this Permit. However, the permittee is encouraged to implement appropriate cautions to ensure the long-term integrity of the bulkhead. Failure of the bulkhead may lead to unauthorized filling or other impacts to adjacent waters or wetlands, which could contravene state water quality standards, thereby violating law. 8) The riprap shall be located immediately waterward of the authorized bulkhead and shall extend no more than 6 feet waterward of the authorized bulkhead. 9) The riprap material shall be free from loose dirt or any pollutant. Alf-Fc Bal Gra Harbor, LLC 4 ADDITIONAL CONDITIONS Riprap Groins Permit # 12-09 Page 3 of 5 13) In accordance with 15A NCAC 07H.0208(b)(9)(A), and in accordance with commitments made by the permittee in the attached letter dated 7/1/08, the authorized groins shall not extend more than 25 feet waterward of the normal water level and shall have a base width of no greater than 10 feet. 14) Except as modified by this permit, the alignment of the authorized 13 rock groins shall adhere to that depicted on the attached workplan drawings. Any proposal to change the authorized alignment may require permit modification. Contact a Division Representative at (252) 946-6481 for this determination. 15) The groins shall be set back a minimum of 15 feet from the adjoining property line and the riparian access dividing line. The line of division of riparian access shall be established by drawing a line parallel to the channel or deep water, then drawing a line perpendicular to the channel line or deep water line that intersects with the shore at the point where the upland property line meets the water's edge. 16) The height of the groins shall not exceed 1 foot above the normal water level. Stone Sill 17) The dimensions of the sill shall not exceed 92 feet in length and 15 feet in width. The alignment of the authorized sill shall adhere to that depicted on the attached workplan drawings. 18) The alignment of the authorized sill shall be staked by the permittee and approved by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Y Upland Boardwalk 26) Unless specifically altered herein, this permit authorizes the upland boardwalk located immediately landward of the authorized bulkhead, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. 27) The boardwalk shall be a maximum of 6 feet wide. The boardwalk shall be slatted, wooden, and elevated. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889. 28) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 29) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. X f,'. } Alf-Fc Bal Gra Harbor, LLC Permit # 12-09 Page of s ADDITIONAL CONDITIONS 32) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 33) This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals s or authorizations that may be required, including but not limited to a Stormwater Permit from the Division of Water Quality, if required. 3 NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 07- 1753. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198000291 (COE Action Id.
