Mr. Sanderson,
We will be processing this permit as a NW12. The crossing will have to be returned to original grade, with no
additional fill placed in the stream or wetland. Please understand that if and when the applicant builds a road
above the sewer line, he will have to obtain proper permits and mitigate for the loss of waters of the US, as if the
sewer line was never there. In other words, we would not lower the mitigation ratio for the road, because of
previous impacts to the wetlands and stream by the sewer line.
Under some circumstances we would ask the applicant to apply for the road along with the sewer line, but it
appears you have avoided and minimized impacts to wetlands and streams by aligning the crossing at the
narrowest point, and crossing perpendicular to the stream.

1. Enclosed are 5 copies of an e-mail from Mr. Thomas Brown of the USACE stating that this
permit will be processed as a NW 12.
2. Enclosed are 5 copies of the Stream Crossing Cross Section Detail showing the streambed
elevation, top of pipe elevation, and the depth of pipe bury.
3. Enclosed are 5 copies of the revised plans showing your wetlands note disallowing fescue and an
approved seed supplier for an approved seed mix in the wetlands area on Sheet C3 of 4.
