On January 28, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
fill 0.06 acre of wetland and to impact 290 linear feet of an unnamed tributary to Little Sugar Creek in
order to construct the Piedmont Town Center in Mecklenburg County.
In order to meet Condition 6 of the 401 Certification for this project, a stormwater management plan,
dated December 18, 2009, was received by the DWQ on December 19, 2008. This revised stormwater
management plan has been reviewed and satisfies the stormwater management conditions of the 401
Water Quality Certification.
The stormwater treatment system, which includes one wet detention pond and the signed and notarized
Operation and Maintenance Agreements dated December 10, 2008, as approved by this Office, and the
drainage patterns depicted on the plan sheets, must be maintained in perpetuity. No changes to the
structural stormwater practices shall be made without written authorization from the Division of Water
Quality. All stormwater management conveyances, detention and treatment structures shall have
maintenance access and at least 10-foot drainage easement on each side to allow for the ability to
maintain the structures, to perform corrective actions and shall provide protection of the structures from
potential alterations by future property owners.
This letter completes the review of the DWQ under Section 401 of the Clean Water Act. If you have any
