WK Dickson is pleased to submit a courtesy copy of a Nationwide Permit 12 Pre-Construction
Notification for the Dry Creek Sanitary Sewer Improvements Phase I project, as discussed on January
15, 2009, This courtesy copy of the PCN is being submitted on behalf of the City of Eden as discussed
in my conversation with you on January 15, 2008. The project is being undertaken to replace an
existing sewer line adjacent to Dry Creek and repair portions of the sewer line to improve safety and
accessibility. Based on an evaluation of the existing sewer line, replacement and upgrading was
recommended to prevent failure, This sewer line is a high priority main and is a maintenance concern,
It also is a significant source of exposure to spills and overflows due to its age, inaccessibility, and
location in a riverbank,
The attached PCN package includes PCN Form, Supporting Figures, Wetland Data Forms,
Jurisdictional Determination Forms (Rapanos), Photo Log, and design plans. Included is a wetland map
for Phase 1 and Phase 2 of this project. Phase 1 impacts are 27.4 linear feet stream impact and 0,065
acres of wetland impact. The impacts are temporary excavation. A 15-foot wide sewer easement will
be permanently maintained. The stream and wetland will be restored to pre-construction contours
and stabilized. The project meets all conditions of the NWP 12 and GC 3699.

3a, Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Land use within the project vicinity is a mix of managed herbaceous cover and mixed upland hardwoods. Adjacent to the
property is a baseball field and other industrial/commercial property, The proposed project is located within an existing
sewer easement adjacent to an unnamed tributary and the Dry Creek floodplain, The topography consists of gently
sloping to nearly level floodplain along the alignment.

A total of 1,79 acres of wetlands were delineated throughout the project property, A 150 ft corridor was evaluated on both
sides (300' total) of the proposed utility line improvements for Phase 1 and Phase 2,

Approximately 7,500 linear feet of streams are adjacent to the project sewer easement for Phase 1 and Phase 2.

The purpose of the proposed project is to provide immediate repairs to problematic sewers and manholes. Based on an
evaluation of the existing sewer line, replacement and upgrading was recommended to prevent failure, This sewer line is
a high priority main and is a maintenance concern, The sewer fits the classification of a "High Priority Sewer" since it lies
parallel to a stream bank along portions of the alignment. It also is a significant source of exposure to spills and overflows
due to its age and location along a stream.

The proposed project entails construction of an 8-inch and 16-inch ductile iron pipe sewer line within an existing sewer
line easement adjacent to an unnamed tributary to Dry Creek. This project consists of a combination of replacement and
point repairs to correct the service defects including root intrusion. Three new manholes are proposed and will be
installed,

Based on budgeting and prioritization, Dry Creek Sanitary Sewer Improvements was broken into three phases, Phase 1
entails higher priority immediate repairs to most severe and problematic sewers and manholes found in a prior inspection.
Phase 1 is urgent since these projects will rectify defects that are imminent threats to sanitary sewer overflows and civil
penalties, Phase 1 consists of a combination of replacement and point repairs and responding to and correcting the
service defects including root intrusion at various locations, Phase 2 is projected to provide the replacement of 5,650
linear feet of 18-inch gravity sewer (part of Dry Creek Outfall) from Mill Avenue to the Railroad Pump Station, Given the
condition of these sewers, the replacement should be completed within two years. A Clean Water Management Trust
Fund (CWMTF) grant will be pursued as a possible funding source for the construction, Phase 3 involves renewal of
19,250 linear feet of sewers ranging in size from 8-inch to 18-inch and mainly located underneath NCDOT and City of
Eden roads.

The North Carolina Natural Heritage Program data source was used to evaluate the project site for protected species, Under
evaluation, one federally endangered species was found to be within 675 feet from the existing sewer lines in Phase 2. The
endangered species is Smooth Coneflower (Echinacea laevigata), Carolina Birdfoot-trefoil is also located approximately 525
feet off the easement which is a (FSC) federal species of concern, The habitat in Phase 1 is maintained recreational ball field
and a small, disturbed forested wetland. No habitat for protected species exists within the current Phase 1, The USFWS will
be contacted prior to Phase 2 permitting. This project should not affect these species being that they are away from the
proposed line of work nearly 500 feet or more, The table below lists the findings for protected species from the NHP data set.

months). A wetland that directly abuts an RPW is also jurisdictional. If the aquatic resource is not a TNW, but has year-round
(perennial) flow, skip to Section III.D.2. If the aquatic resource is a wetland directly abutting a tributary with perennial flow,

A wetland that is adjacent to but that does not directly abut an RPW requires a significant nexus evaluation. Corps districts and
EP A regions will include in the record any available information that documents the existence of a significant nexus between a
relatively permanent tributary that is not perennial (and its adjacent wetlands if any) and a traditional navigable water, even
though a significant nexus finding is not required as a matter oflaw.
If the waterbody4 is not an RPW, or a wetland directly abutting an RPW, a JD will require additional data to determine if the
waterbody has a significant nexus with a TNW. If the tributary has adjacent wetlands, the significant nexus evaluation must
consider the tributary in combination with all of its adjacent wetlands. This significant nexus evaluation that combines, for
analytical purposes, the tributary and all of its adjacent wetlands is used whether the review area identified in the JD request is
the tributary, or its adjacent wetlands, or both. If the JD covers a tributary with adjacent wetlands, complete Section III.B.! for

C. SIGNIFICANT NEXUS DETERMINATION
A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed
by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity
ofa lNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of its adjacent
wetlands, has more than a speculative or insubstantial effect on the chemical, physical and/or biological integrity of a lNW.
Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency ofthe flow
of water in the tributary and its proximity to a lNW, and the functions performed by the tributary and all its adjacent
wetlands. It is not appropriate to determine significant nexus based solely on any specific threshold of distance (e.g. between a
tributary and its adjacent wetland or between a tributary and the lNW). Similarly, the fact an adjacent wetland lies within or
outside of a floodplain is not solely determinative of significant nexus.
Draw connections between the features documented and the effects on the lNW, as identified in the Rapanos Guidance and
discussed in the Instructional Guidebook. Factors to consider include, for example:
. Does the tributwy, in combination with its adjacent wetlands (if any), have the capacity to carry pollutants or flood waters to
lNW s, or to reduce the amount of pollutants or flood waters reaching a 1NW?
. Does the tributwy, in combination with its adjacent wetlands (if any), provide habitat and lifecycle support functions for fish and
other species, such as feeding, nesting, spawning, or rearing young for species that are present in the 1NW?
. Does the tributwy, in combination with its adjacent wetlands (if any), have the capacity to transfer nutrients and organic carbon that
support downstream foodwebs?
. Does the tributwy, in combination with its adjacent wetlands (if any), have other relationships to the physical, chemical, or
biological integrity of the lNW?
