The above referenced Notice of Violation (NOV) was received in our office on
October 30, 2017. The NOV alleged that the annual permit fees were not paid timely in
accordance with the Terms and Conditions of the NPDES permit and 15A NCAC 2H.0105(b)(2).
We have provided documentation to Ms. Teresa Revis via email on October 31, 2017 that this
invoice was paid directly from our accounting department via Check No. 1000092355 on
January 5, 2017. In follow-up correspondence (dated November 3, 2017, see attachment),
Ms. Revis confirmed that the payment had been received and that the records had been updated
accordingly.
With this correspondence, we are respectfully requesting, that based on this updated information,
the NOV issued to the Shearon Harris Nuclear Power Plant be rescinded. If you have any

We received the attached Notice of Violation today for the 2016 NPDES fees at the Harris Nuclear
facility Our records indicate that this invoice was paid directly from our accounting department via
Check No 1000092355 on January 5, 2017 I'm not sure how these payments are recorded, but is
there any chance you could verify if this check was inadvertently applied to the wrong account?

An audit of annual fee payments for NPDES permittees has noted unpaid fees for the subject facility.
Payment of annual fees is required by Part 1113. (12) of your NPDES permit NPDES WW, as well as 15A NCAC
21-1.0105 (b)(2).
The Division of Water Resources is considering an assessment of civil penalties if the past due amount is
not paid in 30 days. The following unpaid invoices are enclosed, totaling $3440.00 in overdue annual fees:
2016PR011388. Payment instructions are provided on the invoice(s). Please submit your payment within
30 days of receipt of this letter.
