The site is developed with an existing single family residence and assoicated outbuildings. The property is accessed by
an existing stream crossing and 60" CMP. The existing 60" CMP and cement block head/end walls are failing. The site
is located in a residential area of Conover, Catawba County, North Carolina.

The purpose of the proposed project is to replace a failing culvert that provides access to a single family residence and
assoicated outbuildings.

The overall project consists of replacing an existing 60" CMP culvert with a 72" RCP (see attached photographs of
existing conditions). Temporary access will be required during culvert replacement. To facilitate culvert replacement,
clearing and grading the vicinity of the existing stream crossing is necessary. Graders, excavators and other heavy
equipment will be used during culvert replacement.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
A culvert replacement is necessary to provide access to the single family residence and associated outbuildings. The
applicant selected to replace the culvert in the existing impact area instead of selecting a new crossing location, thus
significantly reducing net loss of stream. The applicant has minimized the width of the crossing to a one lane road crossing.
The proposed impact area exceeds the existing impact area by only five linear feet of stream due to the installation of a wood
barrier for safety concerns. The applicant has selected to use approximately 7 to 8 foot tall head/end walls to avoid additional
stream impact with road sideslope fill.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The disturbance limits will be staked. A temporary coffer dam will be installed upgradient of the culvert replace and the
proposed temporary access culvert. During construction, water will be pumped around the construction footprint and a
temporary access will be used. Appropriate stream bank protection will be provided in the channel during construction and all
excess excavated material will be immediately removed from the stream bank crossing area and stockpiled or wasted in
upland areas. Upon completion of the culvert replacement, the temporary access culvert and sand bag coffer dams will be
removed and flow will be diverted through the culvert. Following construction, disturbed banks will be restored to similar pre -
construction conditions, matted and seeded/live staked.

The USFWS identifies the following federally protected species in Catawba County: bald eagle, northern long eared bat
(NLEB), dwarf -flowered heartleaf and Schweinitz's sunflower. We have made the determination that the proposed project
will not disturb the bald eagle and have no effect to dwarf -flowered heartleaf and Schweinitz's sunflower based on lack of
suitable habitat. Based on a review of the Jun_1_2016_NLEB_HUC12 NLEB shapefiles obtained from the Asheville
Ecological Services Field Office website, the 12 digit HUC with the nearest confirmed hibernation and/or maternity sites is
located approximately 30 miles from the site. Therefore, the applicant will rely on the final 4(d) rule for NLEB.

Sherri -Please find attached electronic copy of the PCN. I am fairly certain this never made it to your office, but please
confirm. The USPS cannot tell us where it is, but the check for the 401 fee has not been deposited anywhere so I went
ahead with having our bank void it earlier today. Unless, Alan tells me that this is reporting, then please just consider this

Hope you are doing good. Can you please provide me an update to this 401 request?
Cathy has now determined that this would be non -reporting to the USACE (email
attached). It appears that this also would be non -reporting to the State (less than 40'
impact outside existing footprint), but I submitted to State because I was sending it to the
USACE based on their previous determination it was reporting. Please let me know if
you intend to process a 401 or just want to send me an email saying that it's non -
reporting. Either would be sufficient.
