Dear Mr. Williams:
S&ME, Inc. (S&ME) would like to submit additional information in response to your
letter received on January 13,2009 by S&ME via fax.
1. Attached is information from William E. Mitchell Associates regarding
estimated base flow and minimum flow release. The estimate for base flow
into the pond is less than one cfs and the pond has been designed to release all
flow continuously. No water will be impounded for use elsewhere. Any
additional flow will be carried through the emergency spillway which is
designed to carry up to 300 cfs.
2. As indicated on the plans under the "Construction Sequence" section, the
pond will be drained using a pump or siphon system at no more than a 1 foot
per day drawdown rate. The existing dam will be removed once the pond has
reached sufficient draw down and water will then be directed to a temporary
rock dam placed in the downstream channel. Flow will be maintained through
the pond's bottom after pond draining and the riser will be installed in the dry
(in an area that does not received direct flow from any channels that form in
the pond's bottom). It is also important to note that the existing dam does not
have a means of flow release other than water flowing over the dam. The
proposed dam will allow for continuous release of water downstream.
3. Attached are revised pages 6, 10, II, and 12 of the Pre-Construction
Notification along with a Revised Figure 7. The impact totals have been
changed to reflect 1.8 acres of temporary open water impacts.

4. The pond will be drained before the end of March 2009, during a time when
fish will not be spawning. This will reduce the likelihood of fish kills that
sometimes result in summer months from higher water temperatures. Slow
draining of the pond and allowing for flow during initial construction will
likely reduce the severity of any fish kills. East of Eden Farms, LLC is aware
that in the event of fish kills, the fish will need to be disposed or buried to
reduce odor and reduce the attraction of birds and other animals.
5. A copy of the construction plans broken into l1x17 and 8.5xl1 size format is
attached.
Please also note that Mr. Ed Wilson is no longer the appropriate contact person for this
project, and therefore we would like to request that any correspondence be mailed to the
attention of East of Eden Farms, LLC. A revised Page 6 of the PCN is attached,
reflecting this change.

LOW-FLOW MEASUREMENTS OF NORTH CAROLINA STREAMS

ABSTRACT
This report lists the results of more than 7,500 low-flow measurements
made prior to January 1, 1969, at about 2,250 sites on streams in North Caro-
lina. Location data are also given. The graphical correlation techniques and
methods to determine low-flow characteristics for the low-flow site using the
simultaneous low flow at continuous-record gaging stations (index stations),
are described and illustrated. The average discharge and the annual minimum
7-day averages that may be expected to recur at 2-, 10-, and 20-year intervals
are listed for 87 continuous-record gaging stations that can be used as index
stations.
Maps showing lines of equal average streamflow enables the determination
of the average flow for any stream site in North Carolina.
INTRODUCTION
Data on the flow of streams is prerequisite to the design of reservoirs
and other water-supply, water-control, and quality control facilities. As the
State's population and economy have grown, the need for streamflow data has
increased.
The U.S. Geological Survey started collecting data on the flow of streams
in North Carolina about 1895. For many years the principal emphasis was on the
collection of continuous records of stredmflow.
With the expanding development of the State in the 1940's and 1950's there
was an accompanying need for additional data on a larger number of streams.
Therefore, new programs were undertaken to measure flows at stream sites at
which. continuoug~record stati.ons were not being operated. Measurements of
flow made at these stream sites. are commonly referred to as miscellaneous

V. Future Project Plans
Are any future permit requests anticipated for this project? If so, describe the anticipated

It is not anticipated that East of Eden Farms, LLC will require future 404/401 permits
from the USACE nor DWQ. No development is planned for this property.
VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must
be listed separately in the tables below (e.g., culvert installation should be listed separately
from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed
impacts, permanent and temporary, must be listed, and must be labeled and clearly
identifiable on an accompanying site plan. All wetlands and waters, and all streams
(intermittent and perennial) should be shown on a delineation map, whether or not impacts
are proposed to these systems. Wetland and stream evaluation and delineation forms
should be included as appropriate. Photographs may be included at the applicant's
discretion. If this proposed impact is strictly for wetland or stream mitigation, list and
describe the impact in Section VIII below. If additional space is needed for listing or
description, please attach a separate sheet.
1. Provide a written description of the proposed impacts:
Approximately 0.04 acres of permanent wetland impacts are planned for this
project in association with construction of the new dam and excavation of upland
areas to extend the outer edge of the pond. Approximately 1.88 acres of
temporary open water impacts may occur in the event that heavy equipment is
needed for removal of trees that are cut from the pond bottom.
Approximately 111 linear feet of permanent stream impacts are proposed for this
project in association with construction of the new dam. Approximately 45 linear
feet of temporary stream impacts are planned due to the installation of temporary
best management practice devices during draining of the pond.

mechanized clearing, grading, fill, excavation, flooding, ditching/drainage, etc. For
