With the re-verification of NWP 39 on 11/3/2017, and the associated Compensatory Mitigation Responsibility Transfer Form
countersigned by NCDMS on 11/15/2017, the enforcement action begun by the Corps of Engineers on 9/29/2017 is now closed.
Accordingly the Corps will take no further action in this matter and close our file as of the date of this email. Thank you for your
time and cooperation in resolving this matter. If you have any questions or comments please let me know.
