SUBJECT: Pre-Construction Notifcation Pursuant to Nationwide Permit #13
NCDOT Division 9 Bridge Replacement Program Project
Bridge No. 129 on SR 1484 over South Double Creek (Class B), Stokes County, NC
WBS Number: 17BP.9.R.61
Dear Mr. Lastinger:
We are requesting Section 404 Nationwide Permits (NWP) 13 for the replacement of Bridge no. 129 with
a new bridge at the same location over South Double Creek (Class B) on SR 1484 (Dan George Rd) in
Stokes County. In addition to the PCN application, USGS and NRCS site excerpt maps, a"No Survey
Required" form for Historic Architecture, a"No Historic Places or Archaeological Sites Present or
Affected" form for Archaeological Resources, a USFWS Section 7 Concurrence letter, Permit Drawings
and a Stormwater Management Plan are included. The project will permanently impact 54 linear feet of
perennial stream for bank stabilization. Design Standards in Sensitive Watersheds have been
implemented for the project.
Protected Species
The U.S. Fish and Wildlife Service (USFWS) lists James spineymussel (Pleurobema collina),
Schweinitz's sunflower (Helianthus schweinitzii) and small-anthered bittercress (Cardamine
micranthera) as endangered, and Northern long-eared bat (Myotis septentrionalis) as threatened for
Stokes County. No live mussels or mussel shells were observed during a field survey of the project area
on July 2, 2014, however the proposed project area is immediately upstream of the known range of the
James spineymussel in the Dan River, therefore a conclusion that this project may affect, but is not likely
to adversely affect, was reached for the James spineymussel with a commitment to Design Standards in
Sensitive Watersheds. There is habitat in the project area for both Schweinitz's sunflower and small-
anthered bittercress. No species of Schweinitz's sunflower were found during field surveys of the project
area on June 25, 2014 and October 27, 2014. Surveys were conducted for small-anthered bittercress on
May 1, 2014, and none were found. A biological conclusion of "No Effect" was reached for both
Schweinitz's sunflower and small-anthered bittercress.

There is summer roosting habitat in the existing bridge and the surrounding trees for Northern long-eared
bat (NLEB). Anticipated tree clearing impacts for this project are estimated to be less than 0.2 acres. The
NCDOT determined that the project `May Affect, but is Not Likely to Adversely Affect' the NLEB.
NCDOT has determined that the proposed action does not require separate consultation on the grounds
that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0)
and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled.
Bald Eagles are protected under the Bald and Golden Eagle Protection Act. A field survey of the project
study area was conducted. No eagles or nests were observed. Therefore, the bald eagle will not be
impacted as a result of project construction.
