PROJECT SUMMARY: The applicant is proposing to demolish the existing dock, maintenance dredge the existing high ground basin, excavate a new channel area, construct a boat ramp, boat ramp trailer parking, install a concrete bulkhead, access road, gazebo and two floating docks and seven slips. 9. Narrative Description: The David Bradley project is located at 126 Cribbs Lane in Newport, Carteret County. The site is found by turning east off of Hwy 24 onto Broad Creek Loop Road at the first entrance. Follow the road for a quarter of a mile and Cribbs Lane will be located on the right. The site lies on the north side of Bogue Sound in this area. The subject property is 56,537 square feet in its entirety and averages 2' in elevation above NF1W. Currently on the high ground portion of the site is a single-family residence, parking area and underdeveloped lot. The vegetation on the high ground portion mostly consists of live oaks, grass and small shrubs. Along the shoreline of this property is a 25' wide x 236' long fringe of coastal marsh that contains Smooth Cordgrass (Spartina alterniflora). The water depths currently in this area are an average of -1.2' at nlw. The ICW is located several hundred feet from this area. Site visits and aerial photos do not find SAVS within the existing basin area. However with no SAV" S within the basin through field visits and through a bottom study SAV's have been found and become naturalized within the existing channel bottom. A new location has been submitted more landward of the existing channel. Through field verification SAV's were not located within the new channel location. There is an existing basin and dock currently on the property. The existing dock would be removed. The applicant wishes to add two floating docks, a concrete bulkhead, maintenance excavation of the basin, new channel excavation, boat ramp installation, boat ramp parking, access road, seven slips and gazebo. The shoreline has a total length along the NHW line of 135'. There are single-family homes with a private docks to the west and east of the proposed proj ect. The Division of Water Quality classifies this area as SA and ORW waters. This area is not a Primary Nursery Area. This portion of Bogue Sound is open to the taking of shellfish. Carteret County's Land Use Plan dated 1999 classifies this area as Limited Transition and Conservation within the AEC's. There are not any shellfish leases in the area. Substrate composition is mostly sand. David Bradley Field Investigation Report Page 03 Project Description: The project would serve an existing campground (Whispering Pines off of Hwy 24) owned by the applicant in order to provide water access for the existing campground residents. There would be a boat ramp, trailer parking and two floating docks for the existing basin. There would also be a gazebo on the high ground portion. Currently the water depths are at an average of -1.2' at NLW. The applicant is proposing the excavation of the existing basin and new channel area to a depth of -3' NLW in order to provide deeper water access. A concrete bulkhead would be installed to help stabilize the existing basin. Seven new slips would be created within the basin. In order to accomplish what is proposed the applicants wish to build a 20' x 110' access road with an 80' wide turning circle, 57' x 61' trailer parking area on high ground with 5 spaces and a 12' x 110' half paved and half grassed driveway for the boat ramp. The existing impermeable area is 13,687 square feet and after completion would be reduced to 13,663 square feet. A total of 25,000 square feet of high ground disturbance would occur, which would include roads, parking, grading and spoil area (surrounded by a 3' high, 1' freeboard and a 3:1 slope in a 63' x 63' area until dewatered). There is an existing water source supplied by West Carteret Water and an existing septic system for the single family residence on the property. The method used for excavation would be bucket to barge with the spoils stored at a minimum of 30' above NHW in a dike 3' high, with 1' freeboard, 3:1 slope in a 63' x63' area. Once dewatering has completed the spoils would then be removed with a dump truck to an approved location. The basin would measure 80' x 110' with the channel measuring an average of 20' x 376'. The total cubic yards to be excavated for the project would be 1169. The new channel location is currently at an average depth -1.2' nlw with the basin at an average depth of -1.5' nlw. The final depth when the project is complete would be -3' nlw. This final depth would not exceed the depth of the connecting water depth of -3.2'nlw. The proposed boat ramp would measure 12' x 40'. The maximum distance of the proposed ramp below NHW would be 20' with 20' above NHW. The ramp would connect to a 12' x 110' concrete drive with grass middle. The final depth of the bottom of the ramp would be - 3' below NHW. A new concrete bulkhead measuring 2' x 229' is proposed to help stabilize around the ramp area and the shoreline of the new dock area. The average distance waterward of the NHW would be 3 inches with a maximum of 2'. A 10 square foot area of backfill would be placed below water level. David Bradley Field Investigation Report Page 04 The applicant is also proposing to remove the existing dock and add two new floating docks with finger piers. One dock would measure 4' x 83' with four slip areas and the second would measure 6' x70' with three side spaces for boats. The new floating dock closest to the boatramp area would have three finger piers that measure 2' x 13'. Four slips are proposed in this area with three slips proposed in the floating dock at the other side of the basin. The typical boat length would be 20' and would be open runabout. There would also be four tie pilings at the end of each finger pier. During a site visit with DMF on 12/14/07 it was determined that the basin had become naturalized over time due to lack of maintenance. There was an evident shellfish resource along the basin edge that could be impacted, however the applicant is proposing to relocate this resource to a more suitable area. 11.Anticipated Impacts: The proposed installation of the new docks and pilings would result in temporary turbidity. They would incorporate 1310 ft2 and shade 1428 ftz of Public Trust Area. An increase in turbidity would also occur during the excavation and disturb 16,800 ft2 of shallow bottom, which includes the proposed boat ramp. A small fringe of coastal marsh would be filled or excavated during the project and would incorporate 50 ft2. However there should be negligible adverse impacts because the fringe volunteered after the high ground basin was dredged. The high ground development would incorporate 25'000 ft2 of disturbance. There is not a potential to impact SAV's within the basin with docking ingress and egress due to SAV's were not found within this location. During site visits SAV's were found within the existing channel location. Since that time a new location has been proposed more landward of the existing channel. The outer most edge of the new channel would be located an average of 10'to 60' from the centerline of the existing channel. Through site verification SAV's were not observed within this new channel location. The applicant is proposing to demolish the existing dock, maintenance dredge the existing high ground basin, excavate a new channel area, construct a boat ramp, boat ramp trailer parking, install a concrete bulkhead, access road, gazebo, install two floating docks and seven slips with a. total of 1,169 cubic yards excavated for the project. All work is consistent with 7H.0208. All high ground work is consistent with 7H.0209. A small fringe of wetlands would be excavated during the expansion of the maintenance of the existing basin. However, due to naturalization after the basin was dug there should be no adverse impacts. This is consistent with 7H.0208 (b) (A). Therefore I recommend the project be authorized as proposed, contingent upon the following conditions: 1. Excavation will not exceed -3 feet below the mean low/normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 2. Prior to the initiation of any dredging activities within the existing basin and Bogue Sound, the permittee shall, in coordination with the Division of Marine Fisheries, develop and implement a oyster relocation plan for the basin oyster population. Contact the Division of Marine Fisheries at (910) 395-3900 to initiate the required coordination. Notice of satisfactory completion of the relocation efforts must be provided to the Division of Coastal Management prior to initiation of dredging in the high ground basin and Bogue Sound. 3. All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 4. The bulkhead/riprap will not extend waterward more than 2 feet from the mean high/normal water level at any point along its alignment at the time of construction. 5. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification.
