The Corps of Engineers beiieves that ther� may be jurisdictional waters of the United States on t�e subject site, and the permit applicant or ather affected parly who requested this preliminary JD is hereby advised of his or her option to request and obtain an appraved jurisdict+onal determination (JD) for that site. Nevertheless, the permit apPlicant or other person who requested this preliminary JD has declined to exercise the option to abta�n an approv�d JD in this instance and at this time. 2. In any circumstance where a permit applicant obtains an individual permit, or a Natianwide G�neral Permit (NWP) or other generaf permit verification reguiring "pre-construction notification" (PCN), or requests verification for a non-reparting NWP or other g�neral permit, and the permit applicant has not re�uested an approved JD for the aciiviky, the pemnit applicant is hereby made awara of the following: (1) the permit applicank has electe� to seek a permit aukhorization based on a preliminary JD, which daes not make an official determination of jurisdic�ional waters; (2) that the applicant has the option to request an appraved JD befare accepting the terms and con�itions of the permit autharization, and that basing a permit authorization or� an approved JD could passibly result in less compensatory mit+gatian being req�ired or different special canditions; (3) that the applicant has the right to request an individual permit rather than accepting tF�e terms and conditians af khe NWP or other general permit authorization; {4) thai the applicant can accept a permit authorization and thereby agree to comply with all the terms and canditions af that permit, including whatever mi#igation reauirements khe Corps has determined to be r�ecessary; {5} that undertaking any activity in reliance upan the subject permit authorization without requesting an appraved JD constiiutes the applicank's acceptance of the use of the prefiminary JD, b�t that e�t�er form of JD will be processed as soon as is practicable; (6) accepting a permit au#h�rizatian (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form af Corps permit authorization based on a preliminary JD conskitutes agreement that all wetlands and ather water bodies on the site affected in any way by #�at aciivity are jurisdickional waters af the United States, and precludes any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative aPpeal o� in any Federal court; and (7} whether the ap�licant elects to �se either an appraved JD or a preliminary JD, that JD will ba processed as soon as is practicable. Further, an approved JD, a proffered individual permit {and all terms and conditions contained kherein), or individuai permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any adminiskrative aPpeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a}{2)).
