It will most likely be covered under a USACE 404 Nationwide Permit #13 and corresponding DWR 401 certification, however I will verify this for you once you can send me a draft of the proposed design. These permits require that any work be done “in the dry” however we do often approve requests for exception to this requirement. We’ll need more specific details in order to consider such a request. Items that we would consider are:  We will seek input from WRC to ensure they don’t have any specific concerns for aquatic species  We will need a justification of why a “pump around” is not feasible.  We will request that all other options be considered such as deflection of the majority of the flow away from the work area using jersey barriers, sheet piles, etc.  We will require that other steps/measures be taken to limit the turbidity and loss of sediment to downstream waters such as construction staging/scheduling to ensure low water conditions and continuous work until complete, immediate stabilization of work area, turbidity curtain or other temporary instream sediment measures, on-site inspection etc.  We may require that the designer be on-site during installation and use of a contractor familiar with in-stream stabilization/restoration structures can be extremely beneficial in ensuring that the project is completed as quickly and with as little disturbance as possible Please don’t hesitate to contact me if you have follow up questions or when you have a design you can send to me so that I can verify this general information would apply to your project. George, We are exploring our options for some minor repairs on the Little Snow Creek Enhancement Restoration Project in Stokes County. Our engineer has recommended a wing deflector be installed from natural materials adjacent the downstream side of the stream crossing. The original permit allowed for pump around as structures were installed according to Mr. Fowlkes with the wildlife commission and Little Snow Creek project inspector. The repairs are needed adjacent the stream crossing. The stream crossing also had erosion and fencing damage from 2 heavy rainfall events earlier in the year. We may be able to access the repair site from the stream crossing by removing the fence and posts, or from the stream bank itself. Please note either way we plan limited equipment access to the stream. Can we make the repairs without the pump around, our Stokes Soil and Water Board needs this information for planning cost payment? We have a morning board meeting November 15th, and I am sure this item will be discussed. Thanks for your help.
