Scott Poole c/o Ed Flynn Page Two 9. PROJECT DESCRIPTION The project site is located at 10 Backfin Point on Figure Eight Island, adjacent to Banks Channel, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel approximately 0.4 miles south and turn right on Backfin Point. Travel approximately 0.1 miles to 10 Backfin point, the project site, which will be located on the right side of the road. Existing structures on the project site include a single-family home (currently under construction), bulkhead, and private docking facility. The project site is approximately 0.4 acres in size and has an approximate elevation of 5' above NHW. The vegetation currently on the project area consists of native bushes and some lawn grass, however, due to the construction on site, most of the lot was cleared of vegetation at the time of the site visit. The project site has approximately 110 feet of shoreline frontage along Banks Channel. Located waterward of the existing timber bulkhead is a sandy area above normal high water that measures approximately 10' in width. There are high marsh Coastal. Wetland species in this area measuring and extending approximately 20' in width from NHW consisting of Saltmeadow Cordgrass (Spartina patens), Glasswort (Salicornia spp.), and Sea Lavender (Limonium carolinianum). Waterward of the high marsh is a band of Smooth Cordgrass (Spartina alterniflora) measuring approximately 10' in width. Mixed among the Smooth Cordgrass are oysters growing in the sandy bottom. No SAV was present during the site visit. Extending waterward from the bulkhead is an existing private docking facility, which consists of a 47'x6' access pier, a 15'x3' gangway, and a 20'x10' floating dock. Based on aerial photography the docking facility appears to have been constructed prior to 1993 and no previous permits were located. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace and expand an existing docking facility in Banks Channel. The old docking facility would be removed entirely, and a new 30'x6' fixed pier would be constructed at the same angle as the existing fixed pier. A 16'x16' covered platform would be constructed at the end of the fixed pier in an "L -head configuration. From the covered platform extending in an easterly direction into Banks Channel a ramp would lead to a floating platform measuring 10'x20'. From the waterward end of the south side of that floating platform, a second floating platform measuring 8'x24' would extend in a southerly direction creating an "L-shaped" floating platform. Along the northern side of the floating platform measuring 10'x20' would be a boat lift measuring 12'x13'. The water depths in the vicinity of the project area are -6' at NLW. The application states that the floating dock and boatlift will be constructed using a floating work barge to be stored on site. 10. ANTICIPATED IMPACTS: The proposed docking facility would incorporate approximately 984 ft2 of Estuarine Waters and Pubic Trust Area and would result in the shading of approximately 120 ft2 of coastal wetland consisting primarily of Smooth Cordgrass (Spartina alterniflora). The newly constructed docking facility would meet the adjacent pierhead line. The application states the water body width is +600', however, using aerial imagery DCM determined the water body width in this area is 375'. The proposed facility would extend approximately 55' into a waterbody measuring approximately 375' which would meet the % width rule. The proposed facility would not encroach into either 15' riparian corridor setback area. The facility would consist of three formalized slips in waters measuring approximately -6' at NLW. The applicant's proposal has the potential to increase disturbance, sedimentation and turbidity into the adjacent marsh. Minor increases in turbidity should be expected during construction.
