Enclosed is a NWP 39 application for your review. It is submitted on behalf of Brunswick County for
the expansion of the existing Ocean Isle Beach Park, located off of Old Georgetown Road in Ocean
Isle Beach, NC. The expansion will include the addition of 4 baseball fields, 6 pickle ball courts,
basketball courts, a dog park, parking facilities, utilities, and pedestrian paths. Impacts to 0.006 acre
of a jurisdictional ditch (non -stream) are needed to provide access to the ball fields. Note that a
NWP 39 was issued in 2009 to impact 0.03 acre of a jurisdictional ditch for two road crossings. Only
one of these crossings was installed (0.02 acre of impact).
Enclosed are the Pre -Construction Notification form, site maps, and site plan. Please let me know if

Approximately one-third of the site is the existing Ocean Isle Beach Park. Remaining land is undeveloped and forested.
Adjacent land use is residential, a golf course, agricultural, or undeveloped and forested.

The purpose of the proposed project is to expand the existing park. Two impacts to an RPW are needed to provide
pedestrian access between the ball fields and a parking area and between the ball fields and a maintenance facility.
3e. Describe the overall project in detail, including the type of equipment to be used:
The park expansion will include the addition of 4 baseball fields, 6 pickle ball courts, basketball courts, a dog park, a
stormwater pond, parking facilities, utilities, and pedestrian paths. The pedestrian paths will be 8' wide and will have 2'
wide grassed shoulders. 36" RCP pipes will be installed at the two RPW crossings to maintain hydrologic flow (see
attached figures). The proposed expansion area will be cleared of vegetation as necessary and fill material will be brought
to the site to level the area of disturbance. Utilities will be installed. Track hoe, loader, dump truck, bob cat, and other
standard construction equipment will be used.

Impacts were minimized by careful site design. However, a jurisdictional ditch bisects the tract and crossings are needed
to access uplands on the other side. The width of the crossing has been minimized as much as possible (12') while still
allowing safe passage for pedestrians. All wetlands within the tract have been avoided.

Ocean Isle Beach Park Project Summary
The proposed park improvements include the construction of four (4) baseball fields, six (6)
pickle ball courts, two (2) basketball courts, a dog park, and associated drives, parking lots, and
utilities.
The proposed ditch crossing located at the north end of the site is to be constructed to provide
access from the Maintenance Facility to the baseball fields.
The proposed ditch crossing located across the existing driveway from the existing parking lot is
to be constructed to provide pedestrian access from such parking area.
Work to be performed at a later date in the northern part of the site is conceptual at this time.
The conceptual plan includes extension of the drive, additional parking, restroom/concession
building, two sports fields, and extension of the walking trail. This work is not within the scope
of this current project.
Permitted % Impervious Cover for the project including future expansion(s) will be 24%.
Stormwater Permitting will be through NCDEMLR, NCDEQ.

Ocean Isle Beach Park Expansion
Conservative Calculation Approach: The calculation of fill below the normal high-
water mark (NHWM) at the 2 ditch crossings is conservative (high) for the
following reasons:
1. The elevation of the NHWM at the crossings is assigned a value equal to the maximum
elevation of the NHWM within the footprint of the fill area.
2. The elevation of the NHWM (# 1 above) is assumed to be spread over a level plane over
the surface of the footprint of the fill area.
3. The elevation of the flowline at the crossings is assigned a value equal to the minimum
elevation of the flowline within the footprint of the fill area.
4. The elevation of the flowline (# 3 above) is assumed to be spread over a level plane
under the footprint of the fill area.
5. Items 1, 2, 3, and 4 above combine to produce an estimated fill volume greater than the
actual fill volume between the surface of the NHWM to the flowline of the ditch.

_ There are Navigable Waters of the United States within the above described project area subject to the permit requirements
of Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law
or our published regulations, this determination may be relied upon for a period not to exceed five years from the date of
this notification.
_ There are waters of the U.S. including wetlands on the above described project area subject to the permit requirements of
Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published
regulations, this determination may be relied upon for a period not to exceed five years from the date of this notification.
_ We strongly suggest you have the waters of the U.S. including wetlands on your project area delineated. Due to the
size of your property and/or our present workload, the Corps may not be able to accomplish this wetland delineation in a
timely manner. For a more timely delineation, you may wish to obtain a consultant. To be considered final, any
delineation must be verified by the Corps.
_ The waters of the U.S. including wetlands on your project area have been delineated and the delineation has been
verified by the Corps. We strongly suggest you have this delineation surveyed. Upon completion, this survey should be
reviewed and verified by the Corps. Once verified, this survey will provide an accurate depiction of all areas subject to
CWA jurisdiction on your property which, provided there is no change in the law or our published regulations, may be
relied upon for a period not to exceed five years.

across a non -stream tributary. Impact area two is authorized for 0.01 acres for the construction of a road crossing
across a non -stream tributary. The pipe/culvert _bottoms _shall be buried at least one foot below normal bed
elevation. No temporary impacts are authorized.
