Pea Landing, LLC Page 3 PROPOSED PROJECT: The applicant is proposing to make improvements to an existing restaurant and expand an existing commercial docking facility into a commercial marina with 14 wet slips. According to the application, the impervious surface area within the 75'AEC is proposed to reduce by approximately 635 sq. ft. associated with the removal of the existing concrete dumpster pad which is proposed to be relocated over existing asphalt landward of the 30' buffer and removal of existing concrete and asphalt areas bordering the restaurant to be converted to landscape buffer (See Sheet No. 3 of 6). The proposed upland improvements to the existing restaurant include new work within the 30' of NHW for which the applicant is proposing to apply rules under 15A NCAC 07H.0209 (g) for Urban Waterfronts. Structures proposed within 30' of NHW include approximately 1,570 sq. ft. of wooden decking split into two sections, the western section measuring approximately 1015 sq. ft. and the eastern measuring approximately 555 sq. ft. There is 96 sq. ft. of proposed impervious surface for the oyster pit proposed to be located in the center of the eastern proposed section of decking (See Sheet No. 3 of 6). The applicant is also proposing to relocate and bury two propane tanks within 30' of NHW. A CAMA Minor Permit application (# 17-01) has been submitted to the Town of Calabash proposing to enclose a portion of the existing concrete patio landward of the 30' buffer. The applicant is proposing to construct new wooden decking approximately 2'above the entire existing 1,935 sq. ft. platform area which will include raising the existing enclosed building and covered platform. The proposed construction methodology, according to Cross Section A (Sheet No. 5 of 6) comprises leaving the existing platform and pilings intact as structural supports for the proposed raised decking. Based on conversations with the applicant's agent, the structural integrity of the existing pilings and platform area has not been fully assessed by a marine contractor and it is not known if new piling installation will be required. The applicant has stated that the proposed use of the enclosed building would be for retail space as a ticketing booth for the commercial docking facility. The applicant is also proposing to construct new decking in a similar fashion T above the existing 6' in width by 70' in length concrete dock which runs parallel to the shoreline. The new decking will measure approximately 7' in width by 40' in length to meet the 7' in width by 30' in length section recently decked under the aforementioned Certificate of Exemption. An additional 102' of shoreline parallel fixed dock is proposed to extend off the eastern end of the existing dock and will also measure approximately 7' in width. The applicant is proposing an additional dock extension measuring approximately 9' in width by 14' in length. This proposed dock extension will come within a half inch of the existing dock of the adjacent property to the west, which is currently encroaching approximately 5' into the applicant's riparian corridor (See Sheet No. 3 of 6). A new access pier is proposed to extend off the northeastern side of the applicant's bulkhead, originating approximately 40'west of the property line. The pier would measure approximately 6' in width by 99' in length and would extend perpendicular to the shoreline, terminating approximately 30' from the eastern end of the proposed fixed dock. A proposed 10' by 10' fish cleaning station would be located on the west side of the intersection of the proposed new pier and shoreline parallel fixed dock. Approximately 40 sq. ft. of the proposed 100 sq. ft. fish cleaning station would be located over coastal wetlands (See Sheet No. 3 of 6). The proposal also includes a new configuration of floating docks to include a main floating spine measuring approximately 5' in width by 224' in length aligned parallel to the shoreline and located on the waterward side of the existing and proposed fixed docks. Five (5) floating finger piers are proposed to extend waterward off the floating spine, each measuring approximately 4' in width but varying in length. The easternmost proposed floating finger pier would measure approximately 14' in length. The additional four (4) proposed floating finger piers to the west will measure approximately 13' in length, 12' in length, 10' in length, and 9' in length in order to meet the U.S. Army Corps of Engineers Federal Channel Setback (See Sheet No. 3 of 6). This floating dock configuration will allow the facility to accommodate up to 14 slips (See Sheet No. 4 of 6). According to the application, water depths in the vicinity of the proposed slips range from approximately -3.5' to -7.0' at Normal Low Water (NLW). Pea Landing, LLC Page 2 9. PROJECT DESCRIPTION: The proposed project is located at within the Town of Calabash's Historic Waterfront area adjacent to the Calabash River. To find the property from U.S. S Shallotte, turn left onto Seaside Rd SW/NC 904 and travel approximately 2.22 miles. Turn right onto Old Georgetown Rd. SW/NC-179 and continue for approximately 4.5 miles. Tum left onto River Rd. and travel approximately 0.3 miles. Continue straight onto Nance St. for approximately two hundred feet to the property's parking lot which is located on the left side of the street. Existing upland development on the property includes a parking lot, which appears to be located landward of the 75' Estuarine Shoreline Area of Environmental Concern (AEC) and restaurant which is located partially within the 75' AEC. According to the project narrative, there is approximately 6,158 sq. ft. of existing impervious surface area within the 75'AEC. The existing impervious surface covers approximately 35% of the estimated 17,200 sq. ft. of lot area within the 75' AEC. The restaurant building and concrete patio area appear to be located outside the CAMA 30' buffer, however a small portion of existing concrete walkway appears to be encroaching into the 30' buffer (See Sheet No.1 of 6). There is also an existing concrete dumpster pad measuring approximately 144 sq. ft. and ice house measuring approximately 100 sq. ft. located within the 30' buffer. The site maintains an elevation measuring approximately 12' above Normal High Water (NHW). Upland vegetation consists of sparse Live Oak (Quercus virginiana) and Wax Myrtle (Morella cerifera) as well as maintained lawn grass and ornamental landscaping. Approximately 210' of shoreline frontage is stabilized by an existing timber bulkhead, with approximately 42' stabilized by existing concreted bank adjacent to the existing concrete ramp, and approximately 11.'. of shoreline on the westernmost portion of the property stabilized by natural vegetation. Low marsh coastal wetlands are present waterward of the bulkhead and concrete bank with vegetation consisting primarily of Smooth Cordgrass (Spartina alterniflora). The coastal wetlands range in width from 50' to 80' waterward of the bulkhead. Adjacent to the existing concreted shoreline, the existing water dependent access way is by use of two (2) existing ramps, one measuring approximately 12' in width by approximately 20' in length and constructed of concrete, and one measuring approximately 4' in width by 18' in length with traditional wood construction. The two ramps are located approximately 15' apart over coastal wetlands and lead down to a non -conforming fixed platform area made up of several components. One component is an existing L -shape roof covered area located over shaded coastal wetland substrate (See Sheet No. 1 of 6). The roof covered area measures approximately 1,335 sq. ft. in total, of which approximately 955 sq. ft. is an unenclosed, covered fixed platform, and approximately 380 sq. ft. is an enclosed building historically used for retail space. There is an additional approximately 600 sq. ft. of uncovered fixed platform area bordering the roof covered area to the south and west. This is also located over what appears to be shaded coastal wetland substrate. The platform area continues eastward to an existing concrete, fixed dock measuring approximately 6' in width by 70' in length which runs parallel to the shoreline and is located over open water. A Certificate of Exemption was issued by DCM on 09/06/2017 for repairs to a 30' section of this existing dock. It is noted that the applicant expanded the width of the 30' section during repairs by one foot in width, to 7' overall, which was not authorized under the Certificated of Exemption. According to the application, this configuration allows for four (4) slips (See Sheet No. 1 of 6), however it has historically accommodated only one (1) large vessel measuring approximately 25' in width by 100' in length. A ramp measuring approximately 4' in width by 15' in length leads down to a shoreline parallel floating dock measuring approximately 7' in width by 60' in length with a floating finger pier measuring approximately 4' in width by 20' in length which runs perpendicular to the shoreline. The application shows the floating dock configuration allowing for four (4) slips (See Sheet No. 1 of 6), however it has historically accommodated only two (2) vessels, one measuring approximately 15' in width by 60' in length and the other measuring approximately 8' in width by 24' in length. According to NCDOT aerial imagery, the docking facility and non -conforming platform/ building located over coastal wetlands have been existing prior to 1989. A search of Division of Coastal Management files did not reveal any prior permitting history for this property. The Town of Calabash Land Use Plan classifies the adjacent high ground area of project site as Commercial. There are no known archaeological sites located in the project vicinity. The waters of the adjacent Calabash River are classified SA; HQW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. Pea Landing, LLC Page 4 10. ANTICIPATED IMPACTS: According to the application, the proposed upland development would decrease the total impervious surface area located within the 75' AEC by approximately 635 sq. ft. The proposed 1,570 sq. ft. over open decking and 96 sq. ft. of proposed impervious surface for the oyster pit would be located within 30' of NHW. Increases in highground disturbance and erosion should be expected during construction. The proposed fixed dock extensions and floating dock configuration would incorporate approximately 2294 sq. ft. of additional footprint within Estuarine Waters and Public Trust Area. The proposed new access pier and fish cleaning station would shade approximately 592 sq. ft. of Coastal Wetlands. The facility as proposed would not exceed the U.S. Army Corps of Engineers Federal Channel Setback and would extend no more than 35' into a waterbody which measures approximately 250' across, which would comply with the 1/a width distance. A waiver was obtained for the proposed 10' encroachment into the 15' Adjacent Riparian Setback Requirement to northeast. The adjacent property owner to the southwest waived the 15' Adjacent Riparian Setback Requirement for the proposed 15' encroachment. The proposed marina would accommodate up to 14 vessels in waters measuring approximately -3.5' to -7.0' NLW which are closed to the harvest of shellfish. DCM MP -1 Section 6.0 Additional Information 4.1 Section 6. a. Project Narrative 4.1.1 Introduction and Project Location The applicant, Pea Landing, LLC, purchased the existing Coleman's Calabash Restaurant in May of 2017 with the intent to improve the existing restaurant, grounds and docking facilities. The property is located along at 9931 Nance Street in the central business district of the Town of Calabash (See Appendix A). 4.1.2 Existing Conditions The property currently functions as a restaurant (Coleman's Calabash Restaurant) with commercial and charter fishing businesses. The original restaurant building was damage by fire sometime in 2013/2014. The prior owners rebuilt the restaurant, only smaller on the existing concrete foundation (See Appendix A, Sheet 1). There is an existing fixed pier with an enclosed building and roofed structure along with side -to dockage and a floating dock (Appendix A, Sheet 1). A CAMA Minor permit application was submitted to the Town of Calabash on 10/23/17 to authorize.the addition of a roofed area to expand the restaurant within the existing concrete foundation. A CAMA Minor permit was requested for this development so that work could begin in time for the restaurant to reopen prior to the 2018 spring tourist season. 4.1.3 Proposed Action Upland work includes removal of the existing dumpster and concrete pad within the 30' buffer and relocating the dumpster to existing impervious surface. Removal of existing impervious surfaces for landscaping adjacent to the restaurant. Relocating and -burying the existing propane tanks, reconfiguring some of the walkways, addition of wooden decking adjacent to the restaurant and installation of an oyster pit. Within the 75' AEC, existing roof area and impervious surface totals 6,158 s.f. Proposed impervious surface within the 75' AEC totals 5,523 s.f., including approximately 96 feet within the 30' buffer for the proposed oyster pit. There is also approximately 1,570 s.f. of wooden decking within the 30' buffer requiring the Urban Waterfront Rules to authorize the project as proposed. See Appendix A, Sheets 1-3 for details. Waterward work consists of improving the existing enclosed building and roofed structure on the fixed pier, including raising the structures approximately 2 feet to sit on top of the fixed wooden pier that will be constructed on top of the existing concrete fixed pier. Construction of a new wooden pier over the existing concrete pier that runs under the existing buildings and along the shoreline. Extending the fixed pier approximately 14 feet to the west and within % inch of the adjacent fixed pier. Removal of the existing floating dock and extending the fixed pier eastward to within approximately 6 feet of the riparian corridor. Setback waivers are included in Appendix B. Approximately 230 feet of floating dock and 5 fingers piers will be added for side -to tie-up and slip dockage. An approximately 99 -foot long fixed pier will be added to the eastern portion of the property for access. See Appendix A, Sheet 3 for details.
