An initial application was made for an individual 404 permit (to the USACOE) in 2005 (that includes an application to the 401 simultaneously). The ACOE put the application on hold to develop a federal Environmental Impact Statement, this is a ACOE responsibility in these types of cases. They are in the early stages of the development of the EIS. The most recent meeting was held by the ACOE on 10/18 to discuss the purpose and need for the project to be carried forward into the Final EIS. The steps left in the development of the EIS are to determine the selected alternative, the environmental or other impacts, such as environmental justice issues, and the mitigation required. Once that is complete, permitting will follow. I understand that South Carolina is also quite interested/concemed about this project. They have been sitting in on the meetings/discussions the ACOE is holding regarding the project. Based on other projects, I believe the end resolution for this project is some time into the future and may also result in litigation from interest groups (including potentially SC). RP The purpose of this email is to ask for help to issue the permit needed to begin construction on the John Cline Reservoir in drought stricken Cleveland County, North Carolina just West of Charlotte. Federal support has been obtained and construction of the dam requires certification from the North Carolina Division of Water Quality (NCDWQ) pursuant to Section 401 of the Clean Water Act. Over the past 15 years over $1.3 million has been invested on engineering and environmental impact studies to provide the area with a long-term dependable water source. Cleveland County has had over 50,000 new customers connect to the Cleveland County Sanitary District over the past 20 years to get clean water. There is plenty of water rolling down the First Broad River during the wet season. However, the recurring drought has left the area in desperation. A viable solution to this problem was unanimously agreed upon by the Cleveland County Board of Commissioners January 16, 2007 to impound the First Broad River by construction a dam in Lawndale, NC. August 30, 2002 Governor Easley signed an order declaring Cleveland County a disaster due to the extreme drought conditions. Even worse drought is upon this community again.
