I will attach a copy of a letter that recapped a phone conversation I had with Alan D. Johnson back in February of last year. In addition to the project presently being put on hold indefinitely due to the current economic conditions, we had withdrawn our application in January as we changed the design as to no longer impact the stream. I never did receive a correspondence back from Alan in regards to my request for an acknowledgement of my letter; I am hoping that perhaps this letter to you will suffice as maybe Alan never received it? I appreciate your help with this and should you need me, please contact me at 704- 998-8036. 1@3@%vgb? Alan, As per our phone conversation today, Friday the 11t", I am submitting this letter to withdraw our application for permitting. We have revised the area in which we will be putting our irrigation pond and it will no longer impact the stream or surrounding wetland area. I have enclosed an 8.5" x 11" copy of both the grading plan and new site detail showing the location of the pond. If possible, could you send me a letter verifying what we discussed and confirming that we no longer require a permit from DWQ for our proposed activities? I appreciate your help with this and should you need me, please contact me at 704-998-8036. Best regards, Chris Sugar 8418 Delberry Lane Charlotte, NC 28277 Cc: Army Corp of Engineers
