Dear Mr. Brown and Ms. Karoly:
On behalf of MAEVCO, LLC, thank you for assistance from your offices. We are
pleased to submit the following project to you for US Army Corps of Engineers (COE) 404
and DWQ 401 approval using Nationwide Permit (NWP) 29. Birchwood Homes is an 18-lot
residential subdivision in southern Nashville, North Carolina.
Jurisdictional Impacts:
Impacts associated with this constructed project are to jurisdictional wetlands. The
impacts to the wetland involve 0.293 acre of fill, land clearing, and excavation. We are
requesting for an after-the-fact permit using NWP 29. The majority of the impacts are
associated with Par Drive and four adjacent lots. The proposed path of Par Drive will provide
access to this property from Golfers Lane. Upon Par Drive entering the property, the road
was immediately curved to the east to avoid the western wetland areas. The stormwater
pond on Lot 36 was strategically placed to avoid the western wetland areas and large ditch
while discharging to this adjacent ditch. The pond was also placed in an area where the pre-
existing flow discharged. As outlined in our previous meetings and discussions, it is our
understanding that the impacted wetlands conducted and proposed will be allowed to
remain.
Stormwater Detention & Treatment:
The existing dry detention basin was designed according to the Town of Nashville Pre-
and Post-Development stormwater control. This includes the 2- and 10-year storms. It is our
understanding that no modifications to this existing pond will be requested per previous
communications. Please also refer to the attached Dry Detention Extended Basin Worksheet,
Checklist, and signed Operation & Maintenance Agreement. The May 3, 2007 Division of Land
Resources Approval Letter is also attached for your files.

While under construction, temporary, custom sedimentation basins will be installed
outside of the wetland areas to protect them against sedimentation along with other appropriate
sedimentation and erosion control measures in compliance with Town of Nashville, Nash
County, & NC Sedimentation and Erosion Control requirements.

Sediment fence and numerous check dams were placed in the roadside swales and large southern ditch to protect
downstream water quality. Minimal grading was conducted in the pre-existing ditch in front of Lots 8 &9 and the access
area to Golfers Lane. Large logging mats were used during the initial clearing and grading to avoid additional wetland
impacts.

Notice of Violation stated that approximately 12,000 square feet of wetlands and 765 linear feet of intermittent stream channel
were impacted. After subsequent site visits with Mike Horan (DWQ), Thomas Brown (COE), & Jean Manuele (COE) and
other involved parties on May 17, 2007, June 6, 2007, and thereafter, it was determined that southern drainageway was an
ephemeral non-jurisdictional ditch. Also, the road and adjacent areas impacts along with the stormwater pond area was
determined to be approximately 0.195 acres. Attempts to minimize wetland impacts to less than 1/10th acre were conducted
while the jurisdictional determination was on-hold due to the Rapanos Supreme Court isolated wetlands moratorium.

AGREED BY THE PARTIES THAT.
1 • In order tb avoid the cost and delay of further, litigation and without any admission of

agreed that all parties have been correctly designated and that there is no question as to
misjohxkr or nonjoinder.
2. Petitioner shall pay Respondent six thousand twenty4vft dollars and ninety cents

lots, roads, utilities, sftams; and wetlands within the property and the immodift
atca, and all respective impacts, developed to scale.
4. In the event Petitioner frills to comply with any of the conditions of this Agreement or
any of the DWQ approvals obtained hereunder, Petitioner shall immediately owe
Respondent the entire amount of the original cavil penalty assessment, ie., eight
thousand, four hundred twenty-thee donars and ninety cents ($8,423.90); less any
payments already trade.
5. Petitioner expressly agrees that by entering into this Agreement, Pe'titionet waives, for
purposes of collection of any sums due hmundear any and all defenses to the underlying
civil penalty assessmmt, and that the issues is any action to collect said pendty will be
limited to Petitioner's compliance with the terms of this Agreement
6. . Nothing in this Agreement shall restrict the right of Respondent to finpod or take
MfolCement action against Petitioner for any new or sub9egaeut violations of the water
quality statutes, the relevant rules promulgated theroundm or any 441 Water Quality

Certification held by Petitioner. Sirnitarly, nothing in. this Agmemod shall cesthot the

7. The parties agree that the consideration for this settlement is the promises contained
herein and that this Agreement contains the whole agreement between them.
8. This Agreement shall be binding upon the parties, their successors and assigns, upon
execution by the undersigned, who reprrsent and warrant that they are authorized to enter I
into this agreement on beb$kf of the parties hereto.
9. DENR and Petitimier agree that, for purposes of any future bankruptcy proceeding, this
Agreement is not intended as, nor shall it be deemed to coostitute, a novation of airy
claims asserted by the RaVondent against Petitioner. Petitioner further agrees that all
sums payable, to the Dqmtbft of Environment and Natural Resources C DENR")
pursuant to this Agreement art nondischargeable in bankruptcy under 11 US.G. § 523.
Nothing is this Agreema t releases any nondisclwgeability claims that may be asserted,
by DENR in any bankruptcy proceeding, and nothing in this Agree ma t shad be deemed
a waiver of DEWs right to rely on the native of any claim or debt released in this
Agreement to show that the claim or debt is nondischargeable.

I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.

structure, pretreatment including forebays and the vegetated filter if one is provided.

the plan to be acceptable and hereby issue this letter of approval. If any modifications,
performance reservations, or recommendations are applicable, a list is enclosed and is
incorporated as a part of this letter of approval, The enclosed Certificate of Approval should be
posted at the job site. In addition, it should be noted that this plan approval shall expire three (3)
years following the date of approval, if no land-disturbing activity has been undertaken, in
accordance with Title 15A, North Carolina Administrative Code (NCAC) 46.0029.
If any modifications are not incorporated into the plan and implemented in the field, the
site will be in violation of the Sedimentation Pollution Control Act of 1973 (North Carolina
General Statute (NCGS), 113A-61:1-).

Also, this letter gives the notice required by NCGS 113A-61.1(a) concerning our right to perform

North Carolina's sedimentation pollution control program is performance oriented,

project it Is determined that the Erosion and Sedimentation Control Plan is inadequate to meet

Acceptance and approval of this plan is conditioned upon your compliance with
applicable federal and state water quality laws, regulations and rules. This could include the
Division of Water Quality under stormwater or other specific water quality standards, and the
U.S. Army Corps of Engineers under Article 404 jurisdiction. Our approval does not supersede
any other required permit or approval.
Since this project disturbs one or more acres, one such approval relates to the
stormwater that will discharge from your project. This runoff is permitted pursuant to the
National Pollutant Discharge Elimination System (NPDES) administered in North Carolina by the
Division of Water Quality (DWQ). Attached is the General Stormwater NPDES Permit,
NCG010000, as revised October 1, 2001, covering your activity. You are responsible for
complying with the General Permit requirements and.are subject to enforcement by DWQ for
any violations of the General Permit.
Due to the location of this project, it should be noted that a rule to protect and maintain
existing buffers along watercourses in the Tar-Pamlico River Basin became effective on January
1, 2000. The Tar-Pamlico River Riparian Area Protection and Maintenance Rule (15A NCAC 2B
.0259) applies to all perennial and intermittent streams, lakes, ponds and estuaries in the Neuse
River Basin with existing vegetation on the adjacent land or "riparian area". In riparian areas
with existing vegetation in the first 30 feet directly adjacent to the stream, the rule prohibits land
disturbance or new development within the first 30 feet of land next to the water (the remaining
20 feet of the total buffer must be revegetated upon completion of any proposed land-disturbing
activity). In riparian areas with existing vegetation that is less than 30 feet wide, the rule
prohibits land disturbance or new development within the area that contains the existing
vegetation (but not the entire 50 foot riparian area). For more information about this riparian
area rule, please contact the Division of Water Quality's Wetland/401 Unit at 919-733-1788, or a
Division of Water Quality representative at this regional office.
Please note that this approval is based in.part on the accuracy of the information
provided concerning financial responsibility. You are requested to fife an amended Financial
Responsibility Form if any changes become necessary. In addition, it would be helpful if you
would notify this office when the proposed land-disturbing activity covered by this plan is

Dear Mr. Mayo:
On July,. 26, 2007, the Division of Water Quality (DWQ) received your After-the-Fact application dated
July 25, 2007, to fill or otherwise impact 0.249 acres of 404hvetland and 0.00 square feet of Zone 1. Tar-
Pamlico River basin protected riparian buffers and 0.00 square feet of lone 2 'I`ar-Pamlico River basin
protected riparian buffers to construct the proposed residential subdivision. Tile DWQ has determined that
your application was incomplete and/or provided inaccurate information as discussed below. The DWQ
Will require additional information in order- to process your application to impact protected wetlands
and/or streams on the subject property, ffherefore, unless we receive fnve copies of tile additional
information requested below, we will have to move toward denial of your application) as required by 15A
NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following; information so that we may continue to review your project.
Additional Information Requested:
1. Please building envelopes for all the lots with wetland, strearns or buffers on the; site plans.
2. It appears additional wetland impacts will be required to access Lot 8. Please address this.
3. Please provide detailed plans showing culverts/crossings. It is unclear how hydrology will be
maintained in wetlands on Lot 6.
4. Please explain why the storin water pond cannot be reconfigured to ininin7ile or avoid impacts to
wetlands shown as being impacted,
5. Please complete Section VI, No. 8, regarding construction of the proposed storrnwater pond.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will he withdrawn
and you will need to reapply with a new application and a new fee.

Hello Thomas, many thanks to you and Jean for coming out to birchwood yesterday. To clarify the results, we have affirmed the
wetland delineation that I flagged and Kevin Yates field reviewed 2'/z years ago. However, the isolation call will be determined in
the near future, possibly next week, according to Jean. Once the isolation call is confirmed, we will finalize the 401 permit and
404(NW 29 if necessary). We are planning on proceeding with the current project Monday. We also understand that we cannot
exceed the 1/10 acre impact threshold that we discussed yesterday until the applicable permit(s) is issued.
Please let us know if the above is correct and copy all parties. Please let us know if you need anything. This includes the
surveyor signed maps, data forms, etc.
Richard Spoor- As I told you, Nils, Patrick, & I met with Richard yesterday morning. Nils plans on having the wetlands and impact
areas surveyed next week. These results will be provided to you and Mike quickly.
Lastly, I plan on coming to the workshop on the 13th and 14th. Please email me any information and/or add me to the listserv.
