DAVIS Director This correspondence is in reference to your 14 February 2017 correspondence (attached), requesting authorization to perform maintenance excavation within the area authorized under CAMA Major Permit No. 47-10 issued to NCDOT/McMullan Companies on 6 May 2010. This permit was issued for eminence excavation of a man-made canal and access from the Alligator River, a riprap jetty, riprap shoreline stabilization, bulkhead, and a shore side dock to provide dockage for 10 boats. The authorized development is located adjacent to U.S. Hwy 64 on the south side of the Alligator River Bridge near Columbia in Tyrrell County, North Carolina. There is currently an expiration date of 27 August 2020. Your 14 February 2017 correspondence was a request to perform maintenance excavation for the fifth time under the CAMA major Permit No. 47-10 of the authorized area to a depth of -5' NWL. Condition 2 of the permit includes a moratorium on dredging from 15 February through 31 October of any given year without prior approval of this Division and the Division of Marine Fisheries. Please see the attached e-mail correspondence from Shane Staples, Fishery Resource Specialist with the Division of Coastal Management (DCM), dated 14 February 2017, as no objection to the proposed maintenance excavation between 20 February 2017 and 28 February 2017 as long as a turbidity curtain is used to close off the work area from the main body of the Alligator River during work. The curtain shall remain in place until turbidity levels return to pre - excavation levels or for at least 72 hours following completion of work. Your proposal to perform maintenance excavation to a final project depth of-5'relative to normal water level (NWL) of Alligator River, with the installation of a silt curtain prior to ignition of work, within the boundaries of the plat attached to your 15 February 2017 correspondence is hereby authorized. All permit conditions including the 27 August 2020 expiration date still apply and remain unchanged. Thank you for your time and cooperation in this matter. With work starting February 20, 2017 and a completion date of February 28, 2017, weather permitting. The canal, jetty, and shore side dock is located adjacent to US Highway 64 on the south side of the Alligator River Bridge in Tyrrell County, North Carolina. Sand and chaff have accumulated in the man-made canal which provides access to Alligator River for the 10 boats permitted under CAMA Permit 47-10. The present water level is +-2 feet and the permitted depth is 5 feet relative to normal water level. This will result in approximately 903 cubic yards (325ft*25ft*3ft/27) of spoil which will be placed on the adjacent high'ground. A turbidity curtain will be in place prior to starting work and used until sediment concentrations subside to normal levels. The requested extension for excavation during the moratorium is due to the canal only remaining open for approximately six months before refilling with sand and chaff. This causes numerous problems for the commercial crabbing fleet who use the canal for approximately eight months beginning in March to April of every year. By postponing the excavation to the beginning of the season, the commercial fleet is able to benefit from the deeper waterway while it is actually being used. In the latter months of the commercial blue crab season it is not uncommon for the waterway to become unnavigable for a stretch of days, thus a loss of income for all involved. The economic impact can be significant and for this reason we are requesting to perform the excavation starting on February 20, 2017 and ending February 28, 2017. REGAN secretary BRAXTON C DAVIS Director A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the proposal to perform maintenance excavation within the area authorized under CAMA major permit #47-10 issued to NCDOT/McMullan Companies. Excavation in the canal adjacent to US 64 in Tyrell County is proposed to begin on February 20, 2017 and end by February 28, 2017. This is during the Anadromous Fish Spawning Area (ASFA) moratorium on in -water work condition attached to this permit. This moratorium is to reduce potential negative impacts to the spawning migration of anadromous fish such as river herring, striped bass, and shad. However, the project proposes to use a turbidity curtain across the mouth of the jetties that will close off the work area to the main body of the Alligator River lessening the potential sedimentation and turbidity conditions caused by the excavation. For this reason, this office will not object to the project going forward as planned. It is requested that the turbidity curtain remain in place for 72 hours or until turbidity conditions return to normal, whichever is longer. In the future the applicant should make efforts to plan and complete the work prior to the February 15 start date of the AFSA moratorium.
