On December 16, 2008, the Division of Water Quality (DWQ) received your revised application dated
August 7, 2008, to fill or otherwise impact 0.03 acres of 404/wetland and 84 linear feet of perennial
stream, to construct the proposed research park at the site. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below.
The submittal dated December 15, 2008 and received by the DWQ on December 16, 2008, failed to
address the following two item in the September 30, 2008 Request for More Information:
DWQ considers the first phase of this project, construction of the access road, to be high density.
Per the requirements of GC 3705, this phase must comply with Stormwater Management Plan
(SMP) Requirements for Applicants Other Than the North Carolina Department of
Transportation, available at:

T.pdf. Please include an SMP that removes a minimum of 85 percent TSS from the stormwater
generated by this project. For each proposed BMP, please provide a completed BMP Supplement
Form, with all the required items. The BMP Supplement Forms are available at the following
web site: http://h2o.enr.state.nc.us/su/bmp forms.htm.
2. For the remainder of the project, please provide a conceptual stormwater management plan for
the project that includes the following:
a. A depiction of the drainage areas on the site.
b. An estimation of the percentage imperviousness associated with each of the drainage
areas.
c. A calculation of the water quality volume associated with each drainage area.
d. A depiction of a proposed BMP (state the type of BMP you plan to use) on the site plan
that is correctly sized based on the water quality volume.

project to address the problems and inadequacies with your application as it was submitted, you will need
to reapply for DWQ approval. This includes submitting a complete application package with the
appropriate.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity
and any work done within waters of the state would be a violation of North Carolina General Statutes and
