Dear Mr. Richardson:
A Major Variance from the Neuse Riparian Buffer Rule for the subject project was issued
on May 3, 2016 (DWR #15-1288) and modified on June 28, 2017 (DWR #15-1288 V2)
for 23,891 square feet of Zone 1 and 13,686 square feet of Zone 2 buffer impacts.
General Certification # 4092 was issued on June 28, 2017 (DWR #17-0156) for 242 linear
feet of stream impact.
On October 23, 2017, the Division of Water Resources (Division) received a modification
request from your consultant, Soil & Environmental Consultants, Inc. via email. The
modification requests changing the mitigation plan from obtaining credits from the Old
Savannah Nutrient Offset & Buffer Bank to the Falling Creek Nutrient Offset and Buffer
Mitigation Bank. By copy of this letter, the approval for the Major Variance and General
Certification are modified to reflect the new mitigation bank.
All other conditions in the June 28, 2017 Major Variance and General Certification
approval letters remain unchanged and are in effect. This completes the review of the
Division under section 401 of the Clean Water Act, 15A NCAC 02H .0500 and Neuse
Riparian Buffer Rule as described in 15A NCAC 02B.0233. Contact me at 919-807-6360
