Box 5 Kenansville, NC 28349 Telephone No.: (910) 296-0369 (336) 771-4608 Size and location of property (water body, road name/number, town, etc.): The project area is 5841f of stream channel locally known as Indian Grave Creek (a tributary to Tea Swamp), located along Lee Street off of NC Hwy 50 in Kenansville, Duplin County, North Carolina. Description of projects area and activity: Restoration of approximately 5841f of stream bank for the purpose of protecting neighboring property owners' structures and municipal utilities. Stream bank stabilization will be carried out using 5 gabion structures, 7 cross vanes, reinforced turf matting and storm water drainage piping (to be used only within lateral non-jurisdictional drainage ways). Please see Special Conditions on the following page. Applicable Law: ® Section 404 (Clean Water Act, 33 USC 1344) ? Section 10 (Rivers and Harbors Act, 33 USC 403) Authorization: Regional General Permit Number: Nationwide Permit Number: 13 Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements. For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA), prior to beginning work you must contact the N.C. Division of Coastal Management . This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal, State or local approvals/permits. Copy Furnished: NCDENR-Division of Water Quality attn: Cyndi Karoly 2321 Crabtree Blvd Suite 250, Raleigh NC 27604 Indian Grave Creek Bank Stabilization Duplin County AID# 2004 01273 Special Conditions: 1) This authorization permits the discharge of fill material (in the form of cross vanes) in the stream channel within the project area to provide as an energy dissipater which will, in effect, help to prevent further erosion of the stream bank. 2) Living tress along the stream bank within the project area may be cut and removed, however, intact root systems shall not be pulled up and/or uprooted. Vegetative debris must be disposed on high ground. 3) Heavy equipment shall operate adjacent to the stream but not within the stream itself unless prior approval has been granted. Restoration of stream banks is required if damage occurs during access. Corp Regulatory Official December 5, 2008 Date NATIONWIDE PERMIT 13 DEPARTMENT OF THE ARMY CORPS OF ENGINEERS FINAL NOTICE OF ISSUANCE AND MODIFICATION OF NATIONWIDE PERMITS FEDERAL REGISTER AUTHORIZED MARCH 19, 2007 Bank Stabilization. Bank stabilization activities necessary for erosion prevention, provided the activity meets all of the following criteria: (a) No material is placed in excess of the minimum needed for erosion protection; (b) The activity is no more than 500 feet in length along the bank, unless this criterion is waived in writing by the district engineer; (c) The activity will not exceed an average of one cubic yard per running foot placed along the bank below the plane of the ordinary high water mark or the high tide line, unless this criterion is waived in writing by the district engineer; (d) The activity does not involve discharges of dredged or fill material into special aquatic sites, unless this criterion is waived in writing by the district engineer; (e) No material is of the type, or is placed in any location, or in any manner, to impair surface water flow into or out of any water of the United States; (f) No material is placed in a manner that will be eroded by normal or expected high flows (properly anchored trees and treetops may be used in low energy areas); and, (g) The activity is not a stream channelization activity. Notification: The permittee must submit a pre-construction notification to the district engineer prior to commencing the activity if the bank stabilization activity: (1) involves discharges into special aquatic sites; (2) is in excess of 500 feet in length; or (3) will involve the discharge of greater than an average of one cubic yard per running foot along the bank below the plane of the ordinary high water mark or the high tide line.
