Sanders Creek and Bogue Sound, Bogue Watch S/D , as requested in the permittee's application dated 4/3/07, incl. attached drawings (9), CE I, CE3, CE5, & CE6 dtd. 4/3/07, CE2, CE2A, CE 4 & CE4A dtd. 9/2/08, & CE413 dtd. 5/22/07 This permit, issued on January 5, 2009 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the U.S. Army Corps of Engineers. 2) Excavation shall not exceed -3 feet below the normal low water level at the landward end of the basin, with depths increasing to a maximum depth of excavation of -6 feet below the normal low water level at and within the channel. In no case shall the depth of excavation exceed the depth of connecting waters. 3) An earthen plug shall be left between the upland basin area to be excavated and the existing waters of Bogue Sound, and a 24 hour period after completion of basin excavation shall elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. Signed by the authority of the Secretary of DENR and the Chairman of the Coastal Resources Commission. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Jame H. December 31, 2012 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Bogue Watch, LLC Permit #141-06 Page 2 of 6 ADDITIONAL CONDITIONS No excavation shall take place at any time in any Coastal Wetlands or open water areas outside of the alignment of the areas indicated on the attached workplan drawing(s). The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission (CRC), no new dredging or excavation within the PNA shall be permitted, except for that which a variance was granted by the CRC, as indicated on the attached workplan drawings. New dredging outside of the permitted alignment in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at (910) 815-4895, ext. 108 to discuss operations and appropriate lighting, markers, etc. for all dredge equipment. Spoil Disposal 7) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any Coastal Wetlands or surrounding waters. 8) No spoil material is to be placed within 30 feet of the normal high water line. 9) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond the normal low water level to prevent gully erosion and unnecessary siltation. 10) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 11) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 12) The diked disposal area shall be constructed a sufficient distance from the normal high water level or any wetlands to eliminate the possibility of dike erosion into surrounding wetlands or waters. 13) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 4 J i Bogue Watch, LLC Permit 4141-06 Page 3 of 6 ADDITIONAL CONDITIONS Docking Facility 14) In order to be found consistent with the Carteret County Land Use Plan, and in accordance with commitments made by the permittee in the e-mail of 9/3/08, this major modification authorizes a maximum of 9 boat slips. Any reference in the attached permit application forms or workplan drawings to a proposal for more than 9 slips is hereby considered null and void. Any future proposal to add additional slips shall require an additional modification of this permit. 15) This major modification authorizes the relocation of the previously permitted community access pier to the alignment depicted on attached workplan drawing CE2A dated 9/2/08. 16) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 17) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether Y floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 18) Any portion of the permitted access pier and/or docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 20) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public r interest. 22) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 23) This major modification authorizes a maximum of nine formalized boat slips. ti 3 Bogue Watch, LLC ADDITIONAL CONDITIONS Bulkhead Permit #141-06 Page 4 of 6 24) The alignment of the authorized bulkhead shall adhere to the alignment shown on the attached workplan drawings. 25) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 26) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 27) The back fill material shall be clean and free of any pollutants except in trace quantities. 28) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. Breakwaters 29) The authorized sheetpile breakwaters shall be constructed in accordance with the alignment and design depicted on the attached workplan drawings. Boatramp 30) The authorized boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. { Sedimentation and Erosion Control 'F t NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 31) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Bogue Watch, LLC ADDITIONAL CONDITIONS Permit #141-06 Page 5 of 6 32) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). Stormwater Management 33) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8060614. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 34) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 35) The waters adjacent to the permitted project are classified by the Marine Fisheries Commission as "Conditionally Approved-Closed". The construction and/or operation of the authorized facilities shall not directly result in a permanent closure of these conditionally approved waters. Any such permanent closure directly attributable to the authorized facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. 36) The permittee and/or his contractor shall meet on site with representative of the Division and U.S. Army Corps of Engineers prior to project initiation. 37) This Major Modification shall be attached to the original of Permit No. 141-06, which was issued on 9/13/06, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 38) All conditions and stipulations of the active permit remain in force under this Major Modification unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 33642 (DWQ Project No. 061250v2), which was issued on 1/11/08.
