Environmental Resources Management (ERM) has received your letter dated August 31, 2017 'V requesting additional information,for the'above referenced ,project. Per 15A NCAC 02B;.0259(6) Table, of, Uses, overhead electric utility lines with perpendicular crossings that disturb less than, or equal"to 150linear ,feet of riparian buffer'are exempt. Additionally, overhead electric utility lines with perpendicular crossings that disturb greater than 150,liinear feet of riparian buffer are allowed. All crossings for the Projectineet one of the categories. Responses to the requested information are found below: N= 1. Please provide the most recent version of the 1:24,000 USGS Topographic Map. Please cleanly drawing or delineate the -site boundaries�on.the topographic,map. [15A NCAC 02H �p< .0502(b)] Please see attached, Figure 1. _ 2, Please, provide a most recent bound and published county soil survey. The Division recognizes that Overhead Electric Utility Lines impacts other that perpendicular crossings in, Zone 1 and. Zone 2 are considered exempt, impacts [15A NC AC 02H .0502(b)].. Please"explain m' your'response how your project meets .the. BMP following requirements for exemption: Response: ® A miri;mum.of 10 feet wide immediately adjacent to the, waterbody will be maintained such that'only vegetation,that poses a hazard or has the potentiallo grow tall enough to ' interfere with the line is removed. ® The Project will require' a 100 -foot wide right-of-way (ROW) that will be cleared of tall growing vegetation di ..ring construction and will be maintained to preveli tall growing vegetation. Clearing of vegetation.on the right-of=way area will be performed by shear cutting with: a shear dozer off construction mats and by hand cutting iwith saws. The: right-of-way will not grubbed or graded and construction in will be removed once construction is complete. Once the project is initiated, it will be completed as expeditiously as i possible. 2 Environmental Resources Management • The Tar -Pamlico River Basin is adjacent to a protected riparian buffer identified within one of the NC Riparian Buffer Protection Rules. There are no new direct stormwater conveyances to the stream; therefore a diffuse flow plan is not required. If needed . measures will be implemented after construction and during routine maintenance to ensure diffuse flow of stormwater through the buffer. • In wetland areas, construction mats will be used to minimize soil disturbance. They will be removed upon completion. • All towers'associated with the project will be located at a -minimum of 10 feet away from ; " anywaterbody. It is Dominion s standard practice to cross all waterbody's 'perpendicularly. 4'. In the Tar- Pamlico River Basin and Neuse River Basin, intermittent streams, perennial streams, lakes, ponds and estuaries depicted on USGS maps and NRCS soil survey maps are -subject to the Riparian Buffer Rules. Impacts to the riparian.buffers must,be identified on your plans [15A NCAC 02B. 0259 (8)( b)( iv)]. If a stream is depicted on either map it is subject to the riparian buffers: [Note: if the permittee believes the maps inaccurately depict surface waters he or she must consult the Division to secure a formal on site determination. DWR' s'file, review revealed that the riparian buffers have NOT received formal verification by the Division.] Please see attached Figure 3. 5. The wetland, stream and "riparian buffer impacts requested in this application need to be clearly shown and enumerated on the site plan. These impacts need to correspond to the impacts requested in the application. The labels' on the site -plan must be clear and must match the labels of the impacts listed in the application. The Division recommends highlighting by hatching or shading all impacts areas for temporary impact areas and permanent, impact areas. [ 15A NCAC 02B. 0259(8)(b)(iv)] Wetlands, streams, open waters, and Riparian buffers impacts mustbe differentiated by permeant versus temporary impacts. With respect to riparian buffers, these impacted' areas must be further separated by Zone I and Zone II impacts as well. Please see attached Figure 3.
