Dear Ms. Irvin:

The Division of Energy, Mineral and Land Resources (DEMLR) Stormwater Program, received
your letter, dated May 10, 2017, regarding NPDES stormwater permit coverage under
NCG010000 for the subject facility on May 22, 2017.

The subject facility was originally covered under a previous version of NCG010000 (NCG01)
that expired on June 30, 2009. Based on Section III.1) Continuation of Previously Permitted
Projects in the currently effective NCG010000 permit, the subject facility’s construction
activities will continue to be valid with the previous permit conditions (the one that expired in
2009) and will be considered covered still under the currently effective permit. Please be aware
that the above permit condition could change in the next renewal of NCG01. That renewal
process will be taking place this year as it expires July 31, 2018.

As an additional matter, this facility’s landfill activities are also captured under 40 CFR 122.26
and North Carolina G.S. 143-215.1; but they are not currently covered under NCG120000 for
Landfills. They must apply for coverage under NPDES Stormwater General Permit
NCG120000 for Landfills. The application form (NOI) is enclosed; and related information can
