Nationwide Permit 14 and Section 401 Water Quality Certification for
the proposed improvements to NC 268 (Elkin Highway) from NC 18 to SR
1966 (Airport Road) in Wilkes County. Federal Project No. STP-0268(15),
Division 11, TIP No. R-2603. Debit $570 from WBS 34518.1.2.

Dear Sir:
The purpose of this letter is to request a modification to and renewal of the United States Army
Corps of Engineers (USACE) Section 404 Nationwide Permit 14 and North Carolina Division of
Water Resources Section 401 Certification for the above referenced project. The NCDOT is
submitting for approval for an additional 103 linear feet of stream bank stabilization along
Mulberry Creek (Permit Site 13).
A storm event washed out portions of the banks of Mulberry Creek south (downstream) of the
bridge near Permit Site 13. In order to rebuild and armor the stream banks, the NCDOT proposes
an additional 103 linear feet of stream bank stabilization with Class II riprap. These additional
impacts do not constitute loss of waters, therefore do not require additional mitigation.
Including the proposed modifications to Site 13 described above, the total impacts for this project
will now include 725 linear feet of permanent stream impacts, 208 linear feet of stream bank
stabilization, and 0.03 acre of temporary stream impacts. There will also be 0.01 acre of temporary

wetland impacts from utility relocation. The additional bank stabilization in Mulberry Creek is the
only construction change since the original permit application submitted on November 13, 2014.
Please see the enclosed revised permit drawing with revised impact summary sheet.
The North Carolina Department of Transportation (NCDOT) was issued a 404 Nationwide Permit
14 from the U.S. Army Corps of Engineers (USACE) on February 25, 2015 for the above-
referenced project. The USACE 404 permit expired on March 18, 2017. The project is still under
construction and is not scheduled to be completed until 2020. Therefore, a renewal of the USACE
permit will be needed.
NCDOT also was issued Water Quality Certifcation (WQC) No. 3886 from the North Carolina
Division of Water Resources (NCDWR) on December 31, 2014. Therefore, a renewal of the
NCDWR 401 WQC will also be needed.
No changes have occurred to the special commitments for this project.
NCDOT requests to modify and renew the permit for this project. Application is hereby made for
modifcation and renewal of the USACE 404 permit and 401 WQC from NCDWR. We have
provided a method of debiting $570.00 to be submitted to the NCDWR for processing the WQC
renewal request for R-2603, as noted in the subject line of this application.
