D.Smith@usace.army.miI' <Ronnie.D.Smith@usace.army.mil> Subject: Proposed Shellfish Lease: Smith Oyster Co., Robert Smith (Agent), Dare County BL 1909860, WC 1909878 Marla, After review of the proposed lease and historical aerial photographs of the proposed lease area, there appears to be a potential shallow bottom impact and more extensive SAV habitat (see attached aerial) that has historically existed than what was present during the 2017 SAV survey performed by DMF. This area of Pamlico Sound is designated as SA-HQW, and there is potential for displacement of the shallow bottom area and SAV habitat from the use of vessels accessing the lease and gear within the lease area. If the US Army Corps of Engineers issues NW 48 for this proposal, this will require written approval under our General Certification No. 4091 http://edocs.deg.nc.gov/WaterResources/0/doc/493433/Page1.aspx . The application fee will be $240 once the lease is approved and prior to issuance of the 401 approval letter. Please have the applicant include the DWR project # 20171330 on the check since they will be received separate from this application.
