PROJECT SUMMARY: The applicant wishes to construct a new boat ramp, staging dock, and maintenance excavation for private use and is applying for a permit to do so. Field Investigation Report: Vallecillo Page 2 --------- ----------------- 9. Narrative Description: The property is located at 110 Davis Bay Drive in Beaufort, Carteret County. This property is a private single-family residence. The parcel is a 10-acre tract adjacent to Davis Bay, a tributary of North River. Currently, the site has a private access road and a single-family residence with a docking facility. The adjacent properties are also developed with similar residential uses. There is approximately 515' of shoreline along Davis Bay on this tract. This entire shoreline supports coastal wetland habitat. Immediate offshore water depths range from -0' to -4.5' nlw. The subaqueous substrate is firm with shell. The elevation of the high ground of the parcel is +8' above normal high water level. Vegetation on the tract mainly consists of Section 404 and coastal wetland species, pine trees, grasses, and opportunistic shrubs. This tributary is about 96' across at the location of the proposed water-dependent development. These waters are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This area is closed to shellfish harvest and has a classification of SA, High Quality Waters. There is not a Federal Channel in this area. 10. Proposed Development: The applicant wishes to construct a new boat ramp with a staging pier and to excavate areas of the adjacent slough in Davis Bay, a tributary of North River. The proposed excavation is to maintain the traditional and established use of the channel, located approximately 480' southeast of the applicant's existing docking facility. This dredging activity will involve two 9' wide sections that total in the removal of 150 cubic yards of subaqueous material. The first section will be 340' long and the second section will be 190' long. Both areas will result in increasing the existing water depths from -2'nlw to the connecting -3'nlw depths. The proposed boat ramp will be located 135' southeast of the existing docking facility. The concrete ramp will cut through a fringe area of Section 404 wetlands and 795 square feet of coastal wetlands in order to access waters adjacent to North River. The ramp will be 90' long and 15' wide. The ramp will extend 33' below normal low water level. A staging dock is also proposed in association with the boat launching area. It will be located along the north side of the boat ramp. It will be 85' long and 3' wide. Its intended use is to support safe launching and retrieval of watercraft at the boat ramp. The dock will extend 31' below normal water level. 11. Anticipated Impacts: This proposal will disturb about 4,950 square feet of open water for the dredging component. The boat launching area will fill 795 square feet of coastal marsh and shade an additional 159 square feet. It will also fill 75 square feet and shade 15 square feet of Section 404 wetlands. The dock will extend 31' waterward into a 103' wide body of water. These waters are not designated as Primary Nursery Area. Water depths in the immediate area range from 0' to -4.5' nlw. These waters are closed to the harvest of shellfish and there is no submerged aquatic vegetation present. Ross Jr., Secretary SUBJECT: Comments and Recommendations - CAMA Major Permit- Davis Bay, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal is in conflict with 15A NCAC 07H .0208(b)(6)(J)(iii) and will pose a hazard to navigation. This proposal involves the filling of 795 square feet of coastal wetlands. The waters of Davis Bay are closed to shellfish harvest. There is no submerged aquatic vegetation. This waterbody is not a Primary Nursery Area. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) The pier shall not extend beyond 26' from the waterward edge of the coastal vegetation; 2) The boat ramp shall be elevated at least 3' above the coastal wetland substrate to minimize impacts to the coastal marsh; 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge; 4) Any portion of the permitted access pier built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking; 5) The authorized structure and associated activity must not cause an unacceptable interference with navigation; 6) In order to protect juvenile finfish populations, no excavation or filling will be permitted between April 1 and November 1 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries; 7) Excavation will not exceed -3 feet below the normal low water level. CC: Tere Barrett, DCM Ted Tyndall, DCM Project Narrative CAMA Major Permit Application 110 Davis Bay Drive Beaufort, Carteret County, North Carolina Reinaldo Vallecillo, Applicant ,37 Reinaldo Vallecillo, applicant, proposes to construct a private concrete boat ramp, fixed wooden assist pier and to dredge portions of an existing creek channel in order to gain access to deeper water in the Davis Bay area. The property is located in Beaufort, North Carolina, Tract 1 of Davis Bay Subdivision adjacent to Steep Point Channel in Carteret County. Waters in the vicinity of the property are classified as SA, HQW (High Quality Waters) by the North Carolina Environmental Commission (EMC) but are not Primary Nursery Area. The proposed concrete boat ramp is to be 15' wide by 90' long and 6" thick and will first serve as an established area to offload dredge material from a bucket and barge operation also being proposed for the site and then would be utilized as a private ramp for the applicant and other property owners in the Davis Bay Subdivision. The concrete boat ramp is proposed to begin at the upper limit of 404 wetlands and will extend waterward to a depth of -4' NLW. Approximately 790 square feet (predominantly coastal wetlands) will be impacted as a result of the proposed ramp. The location of the boat ramp represents the least amount of wetlands to be crossed to gain access to open water. From upper limit of 404 wetlands to waterward edge of marsh (solid stands of S. alterniflora) is approximately 50 feet. The remaining distance to a -4' contour is comprised of very sporadic sprigs of cord grass, open sand including relic oyster shells and mud flat. The proposed fixed assist pier will be 85' X 3' and serve to provide a stable structure to temporarily tie to while boats are being removed from the water at the ramp. The pier will not have any permanent slips and will be constructed a minimum of 3' above any wetlands. The structure will end at the edge of the navigable channel (-2' NLW) which is the most restrictive setback applied in this proposal. Water body width in the vicinity of the pier is 103 feet from edge of marsh to edge of marsh. The dredging component is comprised of two segments at the mouth of the creek and just upstream of the mouth. The dredging component was designed to avoid North Carolina State Environmental Policy Act triggering thresholds (excavation activities entirely within 100 feet of the shoreline and less than 5,000 sf of public trust bottom excavated). The applicant - 1 - proposed to dredge approximately 150 cubic yards of subtidal bottom to achieve an average channel depth of -3' NLW. The dredging will be conducted by an approved bucket and barge operation and material will be offloaded at the proposed boat ramp and transported offsite to an approved deposition site (770 Hwy 24, Morehead City, NC). No wetlands will be impacted at the offsite disposal area. The boat ramp will be privately owned and utilized solely by the applicant and their guests. No commercial activities or services are proposed. The proposed project involves water-dependent structures only.
