Hi Chris,
DCM has reviewed your e-mail request dated September 5, 2017, which included six revised drawings dated as received
on the same date. The request indicates that approval for a combined total of 8,811 square feet (0.2 acres) of additional
mechanized clearing in wetlands is needed at Sites 19 and 20 on the D-section of the R-2514 project in Jones
County. The request includes a letter from the N.C. Division of Mitigation Services (DMS) dated 8/30/17 assuming
responsibility for satisfying the compensatory mitigation requirements for the additional 8,811 square feet (0.2 acres) of
wetland impacts. The N.C. Division of Water Resources issued a Modification to the 401 Water Quality Certification for
the additional impacts on October 16, 2017 (DWR Project No. 20141169 v. 8, WQC No. 004012).
As you are aware, the R-2514 project is located within three counties, Onslow, Jones and Craven counties. The CAMA
Major Permit No. 43-15 authorized impacts to Areas of Environmental Concern at the crossing of the White Oak River,
and it also conveyed a Federal Consistency Determination for the remaining areas of the project. In accordance with
provisions of Federal Consistency under 15 CFR § 930.46, Supplemental Coordination for Proposed Activities, the
preparation of a supplemental consistency determination is required only if the proposed activity will affect any coastal
use or resource substantially different than originally described. The current request for authorization to impact
additional wetlands at Sites 19 and 20 on the D-section of the project would effect areas located only within Jones
County, which is not one of the designated coastal counties of North Carolina.
Based on the review of the proposed changes as described above, and review of the original Federal Consistency
Determination within CAMA Permit No. 43-15, DCM has concluded that the preparation of a supplemental consistency
certification will not be necessary, and the project with the proposed changes is still consistent with North Carolina's
Coastal Management Program.
Should the project be further modified or revised, NCDOT should consult with DCM to determine if a permit
modification or a Supplemental Consistency Certification pursuant to 15 CFR 930.66 is necessary. If we may
