ELEANOR R. CROWE, and husband, RICHARD DONALD CROWE,
Grantors, to JAMES DOUGLAS FIDLER and wife, DIANE H. FIDLER;

W I T N E S S E T H:
THAT WHEREAS, the said Grantors are now seized and in
possession of the hereinafter described tracts.of land, and now
desire to convey said tracts of land as a gift to their son,
James Douglas Fidler and his wife, Diane H. Fidler, upon the
condition that the said grantees shall pay to Thomas.W.
Fidler, the sum of $8,000.00, said sum representing one-half
of the fair market value of the hereinafter described premises
and mobile home located thereon, and, .

Riverview and recorded in the office of the Register
of Deeds in Pamlico County in Map Book 2 at Page 42,
said point is located North 77 deg. 55 min. East 49.1
feet from the northeast corner of Lot No. 4 of said
subdivision and runs thence North 77 deg. 55 min. East
with the southern line of Lee Road 0.9 feet; thence
North 88 deg. East with the southern line of said road
5.1 feet to the northwest corner of the lot heretofore
conveyed by Matthew Leo Eubanks, et ux to James W. Fidler,

Registry; thence Southwardly to the shore of Neuse
River; thence up and with the shore of Neuse River 6
feet, a new corner; thence a new line Northwardly and
parallel to the second call to Lee Road, the point of
beginning and being the eastern six feet of that certain
lot conveyed to A. W. Pittman, et ux, by deed recorded
in Book 130, Page 150, Pamlico County Registry. And
being the same property described in deed recorded in
Book 156, Page 413, of the Pamlico County Registry.
TRACT 2: Located on the north shore of Neuse River and
being the eastern part or portion of Lot No. Five (5)
of a certain subdivision of the lands of Guion E. Lee.
according to a survey made by Darrell D. Daniels, C.E.,
in December 1954, a plat of which is on record in the
Register of Deeds of Pamlico County in Map Book 2,
Page 42, and being more particularly described as
follows: BEGINNING at the northeastern corner of Lot
No. Five (5) of the aforesaid subdivision and running
thence along and with the southern edge of the public
road which leads from the Lee Highway and along the
northern line of the said Lot No. Five (5) south 88
deg. 20 min. west 54 feet to an iron stake; thence in
a southern direction an iron stake in the edge of the
river, which said stake is located 50 feet from the
southeastern corner of the aforesaid Lot No. Five (5)
as measured along said river shore in a westerly
direction from said corner; thence in an eastern direc-
tion and along the said river shore for a distance of
50 feet to the southeastern corner of the said Lot
No. Five (5); thence along the eastern line of the said
Lot No. Five (5) in a northern direction north 7 degrees
west 79.1 feet to the northeastern corner of said Lot
No. Five (5) and the point of beginning. This being a
part or portion of the lands conveyed to the said Matthew
Leo Eubanks and wife, by Don E. Lee by deed dated .23 May,
1955, and registered in Book 118, Page 177, office of
the Register of Deeds of Pamlico County. And being the
same property described in deed recorded in Book 127,
Page 78, of the Pamlico County Registry.
IT IS UNDERSTOOD AND AGREED that the above described lands
are conveyed subject to all valid and enforceable ease-
ments, restrictions and rights-of-way of record, if any,
and that certain Agreement dated August 20, 1959, between
Matthew Leo Eubanks and wife, Bernice H. Eubanks, and
James W. Fidler and wife, Eleanor R. Fidler, setting forth
all rights and conditions of septic tank located on Lot
Five (5), as hereinabove referred to.
TO HAVE AND TO HOLD the above described lots or parcels of
land, together with all privileges and appurtenances thereunto
