Dear Mr. Smith & Mr. McMillan:
Please find attached one (1) copy of correspondence sent to the Town of Holly Springs responding
to their Notice of Violation for encroachment into Zones 1 and 2 of the Neuse River Buffer
associated with this project. As indicated in this letter and discussed with Todd Preuninger from
our office, this encroachment was made as a result of an error by the contractor. We propose to
resolve this issue by removing the existing level spreader encroachment and reconstructing it
outside of the riparian buffer per the original approved plans. We have also included a re-
vegetation plan for the disturbed areas.
Please advise if you require additional information or have any questions concerning this
information. Thank you for your assistance with this modification.

Subject: Response to Notice of Violation (NOV)
Dear Stephanie and Heather:
As you are aware, the developer for the referenced project received a notice of violation for
encroaching into the stream buffer during the installation of a level spreader. Although the level
spreader was correctly shown on the approved plan and properly surveyed during construction, the
contractor installed the level spreader incorrectly resulting in the encroachment. While this does not
justify the encroachment it shows that the encroachment was unintentional and we regret that it
occurred. The contractor has since gone out of business and we are working with another contractor
to rectify the problem.
Acting on behalf of John Wieland Homes and Neighborhoods (the developer), Withers & Ravenel as
the design team and construction managers are providing a plan that address' each of the concerns
listed in the NOV. Please review and let us know as soon as possible if we have met the Town of
Holly Springs requirements. Upon approval of this plan of action, we will direct the contractors to
begin work and make the necessary repairs and replant the buffer area that was disturbed.

Dear Mr. Patsey:
You have failed to comply with provisions of the Town of Holly
Springs' Soil Erosion and Sedimentation Control, Stream and Wetland
Protection, Land Disturbance Ordinance. A site inspection of Woodcreek
Spine Rd. was made by Drew Johnson, Development Inspector, on
December 9, 2008. At which time he found that level spreader E2 was
constructed outside the approved limits of disturbance and Neuse Buffer
Zones 1 & 2 were impacted with the construction of the device.
Your site is in violation for the following reasons:
? Failure to follow approved plan, G.S.113A-61.1
? Inadequate buffer zone
You must cease and desist all land disturbance activity on site except to
bring your site into compliance with the Town's ordinance. You have seven
(7) working days from the date of this letter to:
1. Submit a plan for removal and reconstruction of the existing level
spreader and fill that impacted Neuse Buffer Zones I and 2 as well
as 100 year flood plain. The plans should take into account the

_ replanting of the Neuse buffer-and any_modifcations to the
approved erosion control plan for this construction
Failure to come into compliance within the timeframe stated will result
in fines being assessed from the date of this letter. However, the Town has
the ability to assess the fine from the day the violation was first discovered.
The maximum civil penalty for a violation is $5,000 per day and each day of
continuing violation shall constitute a separate violation. In addition, the
Town may assess a one-time civil penalty of up to $5,000 for the day the
violation is first detected, regardless of whether the site is brought into
compliance before the established deadline.
Engineering department staff, specifically David Summers at 557-2910,
Heather Keefer at 557-2909, and the Development Inspector for the site,
Drew Johnson, Devlopment Inspector 557-2928, will work with you to
address the problems at this site. If you have any questions please do not
