The Wilmington District previously authorized 0.487 acres of wetland impact in this develoopment under the same Action ID (SAW-2014-01686) on January 28, 2015. As compensatory mitigation for the new impacts, the applicant will provide payment to the North Carolina Division of Mitigation Services (DMS) in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. Basis for Determination: The site contains wetlands as determined by the 1987 Corps of Engineers Wetland Delineation Manualand the Regional Supplement to the Corps of Engineers Wetlands Delineation Manual: Eastern Mountain and Piedmont Region(version 2.0). These wetlands are abutting to stream channels located on the site that exhibit indicators of ordinary high water marks,and have perennial flow.The stream channels on the site are unnamed tributaries (UTs) to Muddy Creek. The UT is a relatively permanent water (RPW)that flows into Muddy Creek (RPW),which flows into the Rocky River, traditional navigable waters (TNW), and then into the Yadkin River (TNW). The Yadkin River flows into the Pee Dee River before entering the Atlantic Ocean. Remarks: The waters of the U.S., at this site, were verified on-site by the Corps on October 7, 2014, March 30,2017,and May 15, 2017,and are as depicted on the Jurisdictional Boundaries-Figure 4 for Saddlebrook Development in Midland, NC (dated April 5, 2017)by Carolina Wetland Services.
