APPROVAL of 401 Water Quality Certification
Dear Mr. Waters:
This letter amends my letter to you on December 3, 2008 regarding the issuance of a 401 Water Quality
Certification for the Bailewick Subdivision. The December 3, 2008 letter stated that you had sixty (60)
days to submit the required mitigation payment. Upon reviewing your file again, the Division of Water
Quality ("DWQ") has realized that the terms of your settlement agreement with DWQ require that you
submit the required mitigation payment within thirty (30) days after the issuance of your 401 Water
Quality Certification. Please submit the required mitigation payment of $30,000 to the Ecosystem
Enhancement Program immediately.
