John,
I am a visiting assistant professor of economics at Virginia Tech. I
live in Winston-Salem and participate in CHANGE (Communities Helping
All Neighbors Gain Empowerment), a coalition of 50 civic and church
groups engaged in grassroots organizing and action, primarily in Forsyth County.
I'd like to know more about the Alcoa hearing in order to determine
whether this is a matter in which CHANGE may have an interest. I
understand that there have been extensive discussions about
recreational use of the system, and some discussion of environmental
issues. Neither is a central focus of CHANGE. We would be more
interested in how much Alcoa proposes to pay for use of the Yadkin
River system, where that money goes, and whether the system could or
should be treated as an asset of the people of the Yadkin basin and
North Carolina. I'd like to know the prior history of this matter
before NCDEQ and elsewhere--the legislature and FERC, and who, aside
from the applicant, has had concerns similar to those I've expressed.
You may not be the best person to address these questions, in which
case, I hope you'll put me in touch the the right folks.

1 A BILL TO BE ENTITLED
2 AN ACT TO STUDY THE IMPACTS ON THE STATE OF NORTH CAROLINA OF
3 THE POTENTIAL ISSUANCE OF A FIFTY YEAR LICENSE BY THE
4 FEDERAL ENERGY REGULATORY COMMISSION FOR THE OPERATION
5 OF THE YADKIN HYDROELECTRIC PROJECT.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. The Environmental Review Commission shall appoint a
8 subcommittee to study the impacts on the State of the potential grant of a fifty year
9 license by the Federal Energy Regulatory Commission ("FERC") to Alcoa Power
10 Generating, Inc. ("APGI") in FERC Relicensing Project No. P-2197-0000. The
11 subcommittee and the Commission shall consider and develop proposals regarding all
12 of the following issues:
13 (1) Analysis the socioeconomic impacts of Alcoa's decision to discontinue
14 its job producing manufacturing activities at its Badin facility that
15 relied on the use of low-cost Yadkin River hydroelectric power.
16 (2) Assurance of an adequate, clean future water supply for the region.
17 (3) Utilizing electricity generation to serve as an economic engine for
18 Piedmont North Carolina.
19 (4) The allocation of water from the Yadkin Hydroelectric Project.
20 (5) Any other related issues that the Commission deems appropriate.
21 SECTION 2. The Commission shall submit an interim report to the 2009
22 General Assembly upon its convening. The Commission shall make a final report to the
23 2011 General Assembly upon its convening. Each report shall include findings and any

recommendations, including legislative proposals that would assist in implementing the
recommendations.
SECTION 3. Nothing in this act shall preclude the Governor or any State
agency or department from taking any action necessary to protect the interest of the
State in the current relicensing procedure for the Yadkin Hydroelectric Project before
FERC or any related proceeding.
SECTION 4. The Department of Environment and Natural Resources
(DENR) shall not take any final action on Alcoa Power Generating, Inc.'s Section 401
Water Quality Certification for FERC Relicensing Project No. P-2197-0000 before the
General Assembly acting upon the Commission's recommendations or May 1, 2009,
whichever occurs sooner. 15A NCAC 02H .0507 (a) and (b) shall not apply to the
application for Alcoa Power Generating, Inc.'s Section 401 Water Quality Certification
for FERC Relicensing Project No. P-2197-0000. Nothing in this act shall preclude
DENR's ability to provide notices, conduct hearings, or take any other actions in
preparation for potentially issuing or denying a 401 Water Quality Certification for
FERC Relicensing Project No. P-2197-0000.
SECTION 5. This act is effective when it becomes law.
