Dear Ms. Homewood:
Your September 25,2017,request for more information on the Rutherwood Substation application
for 401 Water Quality Certification from the NC Division of Water Resources(DWR) states:
"There's one follow up item/issue I need to have resolved. Your response to my item#4 is that a
riprap apron will be installed and the length of the apron will be determined upon pipe sizing. I
understand that an erosion control plan may not have been developed/finalized for this project as
of yet, however, the riprap apron will be considered as permanent impacts to the stream channel,
therefore if it is not specified within this approval then the installation of it will require a 401 permit
modification (and associated fee) and/or would constitute a violation if it is installed prior to
receiving a 401 violation. "
The response is that the entire length of the stream(113 feet including an existing culvert)could be
impacted by the riprap apron. Currently,there is approximately 91 feet of existing stream channel
to be disturbed for construction of the fill slope on the north side of the substation. While
piping/storm drainage design has not yet been finalized,it is estimated that the culvert will daylight
around the bottom of the fill slope,where it meets existing grade. It is estimated that an additional
22 feet of stream disturbance will be necessary(which is up to the existing property line)to install
the required rip rap apron.At this time,an approximate 22-feet rip rap apron will be installed at the
invert outlet of the proposed culvert. The final length of stream impacts will not exceed 113 feet.
Please alter the 401 Permit Application to reflect the change from 91 feet to 113 feet of impacts.
