9. PROJECT DESCRIPTION:
The project site is located 126 Seagull Court, adjacent to Topsail Sound, in Surf City, Pender County. To get to
the site from Wilmington take US Hwy 17 N to NC Hwy 210. Turn right onto NC Hwy 210 and continue to NC
Hwy 50. Take a right onto NC Hwy 50. Travel across the swing bridge to the stoplight. Take a right onto NC
Hwy 50. Travel approximately 2.1 miles to Sound Drive. Sound Drive is located on the right side of NC Hwy
50. Take a right onto Sound. Then take the first right onto Oak Drive North. The next left will be Seagull Court.
Take a left onto Seagull court The project site is located at the end of the road on the right. The property is
adjacent to Topsail Sound on the west and a Seagull Court to the east. The property is adjacent to residential
properties on the north and south sides. The current elevation of the property ranges from sea level to
approximately 3.5' above normal high water (NHW). The property is approximately 19,000 ft.- in size. There is
an existing residential structure on the site. The property has a dock located on the western side of the property
and consisting of an 8' x 16' platform that extends into Topsail Sound. The highground portion of the property
is vegetated primarily with Wax Myrtle (Myrica cerifera), Live Oak (Quercus virginiana), and Red Cedar
(Juniperous virginiana). The high marsh portion of the coastal wetlands ranges from 10' to 20' in width and
consist mainly Salt Meadow Grass (Spartina patens) and Salt Marsh Cordgrass (Spartina alterniora). The high
marsh area transitions to low marsh that consists of mainly Salt Marsh Cordgrass and varies in width from 0 to
10'. The normal high water (NHW) line is located along the transition from high marsh to low marsh.
The Town of Surf City Land Use Plan classifies the upland areas of this project as Developed. The waters of the
project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has
NOT designated this area of Topsail Sound as a Primary Nursery Area, and the waters adjacent to the
proposed project are open to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant is proposing to perform maintenance excavation in front of the dock. The excavation area would
measure approximately 17' in width and 30' in length to a final depth of -3' @ NLW. The total amount of
material to be excavated would be approximately 23 cubic yards. The applicant is also proposing to install 107
linear feet of low profile wooden bulkhead at the waterward edge of coastal wetlands, in an effort to reclaim
property lost due to erosion. The average distance from the bulkhead to the waterward edge of wetlands is
approximately 7', the widest point being approximately 12' in width and the narrowest being approximately 2'
in width. The applicant is also proposing to use the excavated material for the bulkhead back fill (approximately
7 cubic yards). The remaining 16 cubic yards would be hauled off to an approved upland site. Then the area
would be planted with coastal wetland species. The applicant states that the top of the bulkhead would be 2
inches below NHW.
10. ANTICIPATED IMPACTS
The proposed low profile bulkhead would incorporate approximately 500 ft.2 of Estuarine Waters and Public
Trust Area AEC's. The proposed bulkhead fill would create approximately 500 ft.2 of coastal wetlands. The
proposed excavation would result in the disturbance of approximately 510 ft.2 of shallow bottom.

PROJECT NARATIVE
1.0 General Facility Information
The Johnstone site consists of approximately 0.43 acres located on Seagull Court
in the subdivision of Section Two Island Oaks within the town of Surf City, in
Pender County, North Carolina. A topographic vicinity map is attached as
Exhibit 1 illustrating the Site location and adjacent vicinity. Exhibit 2 is an aerial
photograph depicting the project boundaries and Exhibit 3 illustrates the existing
site conditions and its relationship to adjacent property owners.
The objective of this project is to construct a low profile bulkhead along the
property line that abuts Topsail Sound in order to stabilize the eroding shoreline
along this portion of the property, while allowing flooding and inundation during
high tide of the property on the landward side of the bulkhead to the extent it will
support the growth of replanted coastal marsh and wetland vegetation species.
The erosion is being caused by the ingress and egress of numerous vessels which
regularly produce damaging wakes. The applicant is also proposing to
simultaneously perform sub aqueous maintenance dredging/excavation activities
of an area approximately 17ft x 30ft in the canal in front of the existing pier/boat
dock, essentially restoring the original dredge depth of the canal and removing the
sloughed off marsh sediments to be used in the backfilling and restoration of the
coastal marsh. It is notable that the project is not located in an area designated as
Primary Nursery Area.
2.0 Existing Site Conditions/Features
Existing site features include a single story, wood frame home on piles with decks
and porches. A deck/walkway leading from the house to a pier/boat dock situated
on a canal within Topsail Sound that abuts the property. Exhibit 3 is a site map
showing the existing site conditions.
The site is characterized by generally flat topography gently sloping to the west
toward Topsail Sound. There is a pond located on the southern corner of the
property with a bullheaded area along the north side of the pond and another
bulkheaded area on the north side of the house.
A formal delineation of section 404 wetlands and coastal marsh was conducted by
The Clark Group on September 17, 2008 in order to determine the jurisdictional
limits of the waters of the United States and the North Carolina Divin

Coastal Management in all areas bounding the applicant's property. A meeting
was also held with the local CAMA representative to discuss the site and
permitting possibilities. A wetland map with all supporting documentation is
being submitted to the U.S. Army Corps of Engineers concurrently with a copy of
the enclosed CANIA Major Permit Application. See Exhibit 4 for the wetlands
location map.
3.0 Proposed Site Modifications
Proposed site modifications include the construction of a low profile bulkhead
and placement of a minimal amount of fill behind the bulkhead and the sub
aqueous excavation of approximately 23 yards of material in an area adjacent to
the existing pier/boat dock. See Exhibit 4 for proposed site modifications and
Exhibit 5 for excavation information.
The wooden bulkhead (8in wide x 107ft long) will be constructed so that the final
elevation at the top of the bulkhead will be approximately 2 inches below normal
high water. This will allow flooding and inundation of the area behind the
bulkhead to support the growth of coastal and wetland vegetation species. Coastal
species will also be planted in the backfill that is placed behind the bulkhead and
monitored in accordance with standard practices for mitigation. This backfill will
come from the material excavated during the maintenance dredging activities so
as to be of like kind and consistency as the marsh soils characteristic of coastal
habitat. It is estimated that approximately 7 cubic yards of fill will be required.
The remaining estimated 16 yards of excavated material will be transported
offsite by contractor to an approved disposal site.
