In response to your request for additional information dated October 30, 2008, please accept the following: 1. All proposed utility lines will be constructed within road right-of-ways, and will be installed without impacts to waters and wetlands of the United States with the exception of the utility crossing at Impact # 6 (shown on site plan). 2. Eric Tomczak will be responsible for inspecting all site activities and maintaining required rain gauge and monitoring reports and all sediment and erosion and stormwater devices as prescribed. 3. Please find agent authorization letter enclosed. 8. Deed restrictions will be placed on the remainder of jurisdictional wetlands and waters; please find a draft copy of the proposed preservation language enclosed as well as a copy of the preservation exhibit map. 9. There are no proposed stream impacts other than the temporary utility crossing; Impact 4 is a linear wetland identified as a 404 jurisdictional channel on the approved wetland map and Impact 6 specifically avoids a tributary impact by bridging. 10. Please find enclosed a revised PCN impact table updated to reflect the revisions in proposed wetland impacts. 11. Please find enclosed revised PCN that reflects the existence of Isolated Waters. 12. Please find enclosed stream determination documentation. 13. Please find enclosed cross section details for each impact area and note that all pipes will be half buried at existing grade to provide for adequate aquatic life passage. 14. Wetland Impact # 3 has been reconfigured; a portion of the sidewalk was eliminated at this impact so as to reduce the impact area. 15. Wetland Impact # 4 is identified as a 404 jurisdictional channel (ditch); this application proposes to reroute the flow typically carried by this feature into the aforementioned created wetland system, which will greatly enhance the water quality and aquatic life attached to such system versus a linear ditch through uplands. Segregating portions of this ditch will only diminish its functions, which is essentially to act as a vessel that was erroneously installed to direct drainage to the Maple Creek feature as shown on this property. Rather than making an attempt to minimize this impact, it seems prudent to reconstruct it in a more functional location and develop an enhanced wetland feature which will undoubtedly, due to its construction, location and watershed, become jurisdictional. It also will be placed in preservation in perpetuity and will act as a buffer to surrounding properties that may be subject to future development by others. This created system connects back into the existing wetland system adjacent to and draining to Maple Creek onsite so as to maintain the hydrologic impetus into this system. 16. Several attempts were made to avoid the riparian impacts at Impact # 6, however due to the existing grade a 60 foot clear span bridge is the safest, most economical and least environmentally intrusive approach designed and considered. This design will prevent the need for piling placement within wetland/stream systems which oftentimes act to impede or redirect normal flows. We find this to be a reasonable and acceptable compromise to accomplish our need to allow for circulation and public safety of the proposed project. Please find enclosed for your review two additional proposed bridge designs complete with notes indicating why these designs were considered, but not chosen by the project engineer. The permit application has been revised to indicate the presence of isolated waters. f. Impacts and fills have been avoided to the extent practicable while still allowing for reasonable utilization of this property while meeting required standards for traffic circulation to ensure the health and safety of the general public. This project has been designed so that approximately 97 % of existing wetlands will not be impacted and the majority will be placed in preservation. This site plan was created to meet the requirements of Nationwide Permit 29 and to have the minimal wetland impacts; numerous project meetings were held for this purpose prior to the implementation of any plan design and therefore there are few previous plans to indicate attempts at avoidance and minimization, although this was a priority in the design of this project. Please find previous iterations of Impact # 3, which has subsequently been reduced. Headwalls are proposed at all wetland impacts to minimize the discharge of fill material into wetland areas. g. The purpose of the proposed "created wetland system" is to mitigate for the placement of fill in the 404 jurisdictional channel (ditch). As indicated on the enclosed preservation exhibit, the created wetland system will be located along the southwestern property boundary, starting at the southern tip of wetland impact # 4 and extending along the property boundary. This will ensure for the flows and circulation for the waters of the U.S. and State of North Carolina. This will also enlarge and greatly extend the availability of water treatment through a functioning wetland system that will enhance the water quality and provide more habitat for aquatic species, both flora and fauna prior to its interception into Maple Creek (tributary to the Lockwood Folly River). Design criteria will be developed utilizing the Stream Restoration Handbook, prepared by the North Carolina Stream Restoration Institute and North Carolina Sea Grant. And monitoring plans will be developed using the Corps' guidelines to ensure the success and functionality of this created wetland system. h. No mitigation banks are available within this watershed; in lieu fee mitigation has been requested from the NCEEP, we will provide your office with a copy of the acceptance letter upon receipt. Please find enclosed a copy of a preservation exhibit and draft preservation language. 2. a. Please find a full-size site plan and a reduced site plan enclosed, both including the entire project area, complete with key and scale (reduced site plan not-to- scale). b. Please find enclosed detailed plan view and cross section drawings of each impact, complete with key and scale. c. All utilities will be located within road right-of-ways with the exception of the temporary impact shown to the west of the proposed bridge. 3. a. Per your request, the use of directional bore or jack and bore techniques were considered for the utility crossing of Maple Creek, however it has been determined that it would be safer and more cost effective to perform an open trench cut given the vegetation and root structures that may be problematic to laying utility pipes Page 3 December 29, 2008 Proposed Development Lakeside - USACE Response for sanitary sewer and water lines. All impacts will be returned to their original grade and contour, all normal flow channels will be replaced to their original contours, areas will be immediately stabilized using excelsior matting and various native grasses and impacts to vegetation will be minimized to the extent practicable. All excavated material will be placed in such a manner so as not to impact or erode other wetland areas. It is our belief that this impact will be temporary in nature. The area of disturbance will be limited to the minimum necessary to construct the utility line and the top 6"-12" of the trench will be backfilled with topsoil from the trench. All excess material will be removed to upland areas immediately upon completion of construction. b. Reconfiguration of Impact # 3 was considered and a portion of the sidewalk was eliminated at this impact so as to reduce the impact area; this reduction is reflected on the enclosed PCN. c. Onsite preservation of remaining un-impacted wetlands onsite is proposed The 404 jurisdictional channel that is to be impacted will be diverted along the southwestern property boundary and an additional wetland area created. We have contacted the only listed private mitigation bank in the Lumber Basin, Stone Farm Regional Mitigation Bank and are pursuing mitigation options through them although at the time of this application they have not signed their contracts and are not ready to do business. If we are unable to secure mitigation through a private bank, we would be willing to seek mitigation credit through the NCEEP. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form.
